Cell Phone Citation - anyone ever got one - what was the ticket

    A small company down the road from ours just had a driver get a ticket for texting while he was driving in our town. Officer that gave the driver the ticket said he needed to appear in court to see what his ticket/fine would be? Company owner wants to know what the ticket might be for a first offender and what will the company get dinged on their FMCSA ratings? Any info I can pass on to John would be helpful.

    Has the driver ever taken a drug test? Maybe have the driver apply at uber.

    Don't know. I just know he has 20+ years of experience and he has driven for john for 4 years.

    In NJ 200 first time 400 second time. Pa. I think is worst. I would recommend getting a local lawyer. And try to get it reduced. I have a pa license and they sent me a letter stating pa considers a cell phone charge a serious offense.

    Tell John he needs to contact the court and see what the fines are going to be, I am guessing $2500 or better.

    There is no first offense, the owner is obviously not too bright to understand what the rules/regulations/laws are and needs to act like an owner.

    ALSO if the driver has 20+ years, he should know better.

    hopefully the driver pays the fine, and if the company owner gets dinged in any way (but i doubt it), then fire the driver too.

    Fines and Penalties - Using a hand-held mobile phone while driving a CMV can result in driver disqualification. Penalties can be up to $2,750 for drivers and up to $11,000 for employers who allow or require drivers to use a hand-held communications device while driving.
