First week first wreck

    i do believe you will still get dinged on your license in your home state. it could affect your personal insurance carrier for your personal vehicle. should be no points however, just marked as an accident.

    better check with your home state's DMV in about 4 months.

    this accident will have to be noted on all applications you fill out, when asked..."amy accidents in the past x number of years? your employer will certainly keep this accident on file.

    I doubt this will effect your license or insurance but no matter what, you can be dinged with a lawsuit by the driver even if he is at fault.

    reason why i said it "might" ding his license and insurance at home, was due to me having a motorbike wreck. i was not at fault.

    but when i went for new insurance on my car, the accident showed up on my DMV record, even showed no fault, but the new insurance dinged me for it...

    so i stayed at the old car insurance company. then when that accident fell off, i was able to get that new insurance, for a lower price than if i still had an accident on my record...

    Yeah I get that now, bad me.

    However if his concern is over a speeder who ran into this trailer, and it is NOT a preventable, then it isn't going to show up.

    I had an accident where another truck refused to yield my right-a-way in my own lane, took off some of his front end, took out his left drive tire and shifted his entire load. I was in front of the clown, and he was pissed off that I didn't let him pass on the right or move when he was trying to get into my lane - there was no where for me to go. I have yet to see anything about that issue on my mvr or even mentioned by my insurance company. The only thing I got was a summons three weeks later to be a witness in court which I did appear and the judge was not too happy with the guy telling him the same crap he told me about my mistake as a driver and having to yield to him.

    Yes, further just because you are not listed as at fault don't mean you are immune to having legal action against you. (contributing reasons like speeding can get you in trouble.). That sign may say 70 MPH however you can still get dinged going 70 MPH in some places because a driver was going to fast for conditions. In fact this too fast for conditions in regard to contributing reasons is the source of more headaches then you can imagine. @TROOPER to TRUCKER used to be a cop. I'm sure he is VERY AWARE of this. You can go into a truck stop and listen to all the Truck Stop Attorneys going on and on about how they can't do that. Trust me legal advice that they can't is pure 100% cat litterbox filler material.

    This is a very important reason to log your sleeper and off duty time very accurately as well. Lawyers will dig into your 10 hour breaks looking for illegal activity like swiping your shower card or ATM card while you were logged Sleeper time and can use that to say you were fatigued and that you would not have been at that location at that time if you had been properly logging your time and fully rested and not fatigued.

    Sometimes you can do everything right and still get dinged. I was retired at age 52 after a 30 year career and was in great financial shape. My then 16 year old daughter was driving the speed limit in my F150 and hit a kid that ran from between two parked cars and she hit the kid. Two broken legs and beat up pretty bad. My daughter was not at fault in any way, but the family was uninsured and a judge ordered my insurance to pay for all of the medical bills because the family had no coverage. Thankfully the kid made a full recovery, but they weren't done with me. They got a lawyer and sued me personally as the registered owner of the truck for "pain and suffering". I decided to fight it to the bitter end and it went to a jury trial. Tens of thousands in legal bills later, the jury felt sorry for the family and awarded them all of my retirement and life's savings. I managed to keep my house which I could no longer afford unless I started working again. So at age 55 I chose a new career and got into trucking. Currently getting my authority to be an O/O and trying to build back up a nest egg before I drop dead from old age.

    What doesn't kill you makes you stronger, so I hear.

    It will show up on your PSP as an accident, where it will stay for 5 years. No other details other than "accident" will be available.

    It will NOT show up unless a CVSA/MCSAP/DOT cop fills out an inspection report and reports it. DOT Recordable accidents DO NOT get reported to the feds like this.

    Hold on to the documentation.

    Write out a ledger pad saying this is exactly what happened, where it happened, how it happened who it hurt or did not hurt (The part about kids flying.. rugh) When it happened. The weather sitation. Your drive cam video of the hit. (You did have a drive cam video RIGHT?! No? Buy one today.)

    Name full names and titles of the people you called in your entire work force write down who told you what, what trailer you dropped (What damaged it had on it...) and what trailer you picked up. You also went through your tractor too right?

    In short keep everything.

    So that if this rises up and tried to bite you some day you will literally have a complete and absolute full story first hand. And the more complete you are with names, places, vehicles, tags, damage, hurt kids etc etc etc the more formidable your position should be.

    If I have to tell you anything...

    Sit up and pay attention when in a difficult spot like a work zone. IM pretty sure something is goiing to happen to you again in one, and your bad habits might not give you the time, space or room to get clear of a problem.

    Some of these roads are so crappy they get a new workzone established once the first one is finished badly. Some have been replaced to bare dirt in my life time two or three times and still have work zones on them.
