Cell Phone Citation - anyone ever got one - what was the ticket

    Not to mention, our tablets have a little card with instructions on how the dot guy can have a report generated and either displayed or emailed to them.

    If you look at the spec you need to be able to plug a USB drive into the device, like this one. The DOT Officer should be able to download the encrypted files, then take the USB drive and plug it into a laptop that has the ability to unincrypt and read them. The spec does not state it needs to plug into a laptop, it states it needs to have the ability to plug a storage device into it to download the files. They need to plug one of these into the device, notice it has the same plug as the USB charging cable, so it would be impossible for them to plug it it. Screenshot 2018-04-29_07-26-52.png

    Rme.. your reading too much into it. They make jumper cables for usb to micro usb. Do you think they didn't know tabs and phones dont have a usb ports? My guess is the hard mounted type do have a usb port, and thats what they are talking about.

    II would carry one, I know the scale house in Castaic doesn't and they will put you OOS until you go get one at WalMart or Best Buy. I wasn't aware of it until I was there 2 days ago and a driver had to get an Uber and go get one at Wal Mart, said his boss didn't know either.

    I think you are confusing USB version (software and hardware combination) with the plug type.
    Thumb drives typically have a (full sized) Type A plug, while phone chargers are something else. Micro Type a is common, mine uses type C. There are dongles to allow a Type A to micro b. It's stll all part of the USB 2.0 spec.

    Ok, I actually went and looked at the regs. Here is what it says about USB 2.0. So yes it does require an adapter.
    Now that being said, it's not required at a roadside and I'm sure that LEO was wrong (Wow, shock there!)
    The reason is this regulation:

    He can use wireless transfer assuming he had a cell signal. No need for the backup of a USB. Don't get me wrong getting an adapter is recommended, but it's only for those time wireless doesn't work. And if he was at a scale that had an Uber close enough, he had cell signal I'm sure.
    Of course if it was a tablet that doesn't have cell usage.....

    The first comment in this thread was about the fine for texting and driving. Later we discover that the driver was checking his hours. Than we discover that the phone is the ELD. Seems like they can check the phone records to verify if texting took place. If not it is still considered using a hand held device while driving. Which is also the mandated use of the ELD.

    He better get a lawyer or have some phone records proving he wasn't actually on the phone. Same happened to me.. But I had phone records to back to what I said so it got thrown out. But for the record, you can use your phone if you're using your GPS.. So if you have a habit of holding your phone for whatever reason, you better have that Google maps up and running.. Just a FYI and that's the law. You can't get a ticket if you're using your phone as a gps

    texting while driving and use of a mobile communication device are two separate things. Do not get caught with the phone in your hand for any reason. Mount it on dash and within your reach so you do not have to alter your seating position to be able to use it by touching 1 button to answer

    §392.82 Using a hand-held mobile telephone.
    (a)(1) No driver shall use a hand-held mobile telephone while driving a CMV.

    (2) No motor carrier shall allow or require its drivers to use a hand-held mobile telephone while driving a CMV.

    (b) Definitions. For the purpose of this section only, driving means operating a commercial motor vehicle on a highway, including while temporarily stationary because of traffic, a traffic control device, or other momentary delays. Driving does not include operating a commercial motor vehicle when the driver has moved the vehicle to the side of, or off, a highway and has halted in a location where the vehicle can safely remain stationary.

    (c) Emergency exception. Using a hand-held mobile telephone is permissible by drivers of a CMV when necessary to communicate with law enforcement officials or other emergency services.

    No mention of a GPS exemption. Do you have a cite or is this truck stop counter crap?
