I'll let the lawyer figure this out. If I'm unloaded and it's friday afternoon, I'm going home and it's usually 300+. Again, most of these 'rules' are open for interpretation, which makes it nice for the revenue agents.

Do what you want let the courts do their job; if it comes to that. Continuing to let revenue enhancement personnel interpret the 'rules' will lead to no good. Since we already know that none of these'rules' has any bearing on safety.

If they put you out of service on one of those CSA violation forms, there is no going to court over anything. In fact the violation will carry so many 'points' and the OOS carries and additional 2 'points'.

It is not that difficult to use P/C, in fact they relaxed the rule a little in our favor but like most things in life, give someone an inch and they want the whole mile.

I feel sorry for the op he gives us fair warning on what they allow more or less.. and here we go with the I do this all the time comments again ... his analogy about whether it can be done with a taxi is a great one

Open for interpretation that’s the problem.Be careful in PA they don’t seem to recognize PC. Been wrongly ticketed twice myself. The fmcsa states unladen as criteria. I always understood you can run home empty on PC however must log on duty from home when returning to work. I’ve read the regs. I use paper logs still and write the words personal conveyance after off duty. What else can you do if your going to shop or eat etc. Always weary about that can of worms. Now Elogs are being manipulated. Another way to make a buck

Legitimate question: What if you are an O/O and do all the maintenance on your truck? You pull in to a truck stop, or preferrably NOT a truck stop, to take your 34 but you need an oil change or tire service. The government is actually trying to tell you that you CAN'T drive short distances (same town, loaded or not) to maintain your own personal truck on your 34? What the hell is it for, then? I've done this a few times. It's robbery to say you have to do this on 'on duty' time. If you are an O/O there is little off duty time even if you're home and empty.

Same could apply for "off duty" time. I could be in the bathroom logged line 1 and my phone rings. On the other end is a broker calling about my posted equipment availability. Now I'm on a business related call so therefore technically I'm "on duty, not driving" because it's work related. The HOS are a joke when taken to the letter of the law.
