We’re you on the way to or from a shipper/receiver or your trailer?
Do you mean ‘off duty’ or ‘off duty driving ‘
Paper logs or elogs?
If you’re on paper, and in off duty status - and driving, then I believe it’s “falsifying logs”.Last edited: Nov 17, 2018

Yes you can fight it. I think everyone should fight there tickets as it makes the officer show up in court. The more we can pull them off the street the less trouble they can cause.

I’ve gotten 3 over the years in Pa.First one was in lieu of a rolling stop sign. Went to court and used exemption clause as Officer didn’t give me chance to catch it up. Actually I got lucky because criteria is OOS vs not current. Gave Judge copy of reg from fmcsa.( I didn’t have a log book at time 1st of mo.)Officer was angry Lol. Reminding Me afterwards of lack of Logbook . I replied I could have made one up on blank paper! It was funny. Second time bobtailing got put OOS for 10 hrs. wrongly.Had TVC fight it and got changed to improper equipment. Lawyer stated I was lucky no $10,000 fine. And no CDL suspension. I told Him he was confused as I didn’t Violate OOS just had simple log book and am now looking worse to DMV - I can’t believe I know more about the Law than you or the Cops. Thanks for nothing. Last time 4 yrs ago drove less than 1 mile empty. Had Local Cops w/ DOT Authority ( all 3 cases were locals w/DOT Cert.) arguing I deserved a ticket. However I know better and after 2 hrs of them trying to get me to agree I was wrong I told them they should be protecting public instead of shaking me down. I was yelling and shaking my finger in their face, it felt great. I figured why not tell the truth they know it’s BS. I got a ticket for Falsifying log and $500 fine. They then encouraged Me to go drop trailer and bobtail wherever I wanted. Unbelievable they insisted it was fine to do. I sat tight for 10 hrs Drove 300 miles in a blizzard to court and got reduced to $50 not current. Had it not been Holidays I really wanted to refuse that deal on principle. They denied telling me to go bobtailing .A red Jeep had checked on me 3 times while shut down . They would love to get me on violating OOS.They play that game in Pa.theyre dirty rotten. I believe you can fight it. Usually before a money hungry Magistrate and may have to appeal and go before a real Judge. What they are doing is a violation of Law IMO and my civil rights by shutting Me down illegally for 10 hrs. It’s rampant as easy $$ in Pa. Have heard a lot of stories of similar cases.I wish the feds would catch them Ike they have Tn and Mn in past.Good Luck and defiantly can be fought but maybe only won by appealing. On that last ticket I think Had I refuted my level 3 inspection first before a Judge in Pa. to keep my safety rating clean and winning that case.I would have automatically been able to win the actual ticket itself.
Moephilly1 and Midwest Trucker Thank this. -
It depends on wear you were going, I would think. If you reposition you bobtail to pickup a trailer then no it won't be legal. If your just going to the movies or resturest or shopping it would be legal.
If your driving 150 miles to shop at Walmart that probably won't sound to good. If you going 150 miles to home and coming back on Monday. It legal but you have to convince the Inpsector that all you doing. IF your150 miles from you home address and going that way he might believe you.
You know what you are doing. Did you bobtail to go home or shopping or something. You can't just claim Personal Conveyance and bobtail or pull a loaded trailer anyplace you want. I used Personal Conveyance last night because I ran out of hours at delivery and they don't have any overnight parking. So I went 30 miles to the First Safe Place to Park. So it depends on why you were bobtailing and not logging it.Alexander suero Thanks this. -
