Today I was coming from Texarkana on i30 I had just passed the rest area around the curve about a truck length in front of me it's brakes lights the car is stopped in hammer lane it's raining but still visible I'm going maybe almost 60 I just pulled Hill I'm 73000 I ended up hitting left rear of car I had seconds to make a decision 4 options ditch my truck people leave me there, run into gaurd rails the people leave me there, lock my brakes risk jack knife making truck on granny lane hit me, or hit two cars on my right I got dash cam footage the trooper bypass me went straight to car they lied said a car hydro plains in front of them that's why they stopped I tell my side I didn't have enough time to stop I'm not expecting a car to be stopping in hammer lane when there are no exits the trooper told me it's my fault I was going to fast I replied if I was going fast my front end would be in drivers seat then he said I was traveling too close I show him video of accident of me being no where behind car till it was too late then trooper went to the law states that anytime I hit some one from back it's automatic my fault I told him the people were sitting in hammer lane not moving trooper says be glad I'm not giving u a ticket then he tells me that if I can't get my light to stay in he was going to tow me for having busted head light after I hit a car sitting in road not moving I'm still confused how he determine it was my fault when he saw on video what the people did my company told me don't worry about it they gone fight for me I did more damage to my truck than their car I didn't have no way out I was going to hit something

Anytime a 4wheeler is doing something dumb and you're in close proximity of it-its automatically your fault. Maybe you can post video?
rabbiporkchop, PE_T and fss99701 Thank this. -
Responding to respond later. Gotta ponder this a bit.
G13Tomcat Thanks this. -
Lawyer up, call the "Hammer"
Oh wait, he only Sues big trucks with $$$ not broke knuckle draggers in 4 wheelers.
Seriously though get a lawyer and show him your video -
First I would have done the same thing that trooper did.
Too fast for conditions is a catch all. It simply means that you were traveling too fast for the conditions. In this case the conditions were the rain and a stopped vehicle.
Now having said that I will say that law may not seem right but unfortunately that is just the legal system.Lepton1, Tonythetruckerdude, Diesel Dave and 10 others Thank this. -
We get a lot of stupid people like that in Alaska every summer that stop on blind curves in the middle of the road to take a picture of a moose taking a crap or some stupid ####.
I feel for you man best thing is to post that video online so we can watch it. take a copy to court and get a lawyer and try to fight it.Last edited: Mar 10, 2019

It's automatically your fault when you "Fail to control speed to avoid collision" from behind. That's in Maryland's Statues. At best a 45 dollar ticket. At worse involving manslaughter by CMV etc.
You are going to need to lawyer up. If you are not punished criminally, you will be punished with a suit civilly.
My option would have been the median for better or worse. It would not be another car with people in it. Ive been there.snowlauncher, PE_T and fss99701 Thank this. -
