your truck is considered federal gov property. the fuzz can go threw your truck for any reason or not. get caught with any booze in your truck and get someone else to post your out come. have i bought a couple beers before and drank them in the truck when i was parked. yes, but having beer, wine, liquor in the cab is a huge no no if your caught js

No they can not search your truck without your permission period, unless they get a warrant, with the exception of customs officers, and it is perfectly legal to have a beer or drink in your truck when you are parked. It is not legal to have beer, wine or any other while you are in transit, unless it is on the manifest.
I have had them try and put a drug dog in my truck, if you notice anytime they try to search your truck or even your personal vehicle they will tell you they are going to, then hand you a form to sign. That form is a permission slip, sign it if you want, they get mad when you don't but can get glad in the same pants.

What does that have to do with the price of eggs in china. Mostly because they don't have the license to sell it to start with, maybe because they don't want drunks in the parking lot.
Now I have a hard time beliving your 99% number to start with, but by the same token why does thw ones that do sell it, sell it, it sure it isn't because it is against the law. I know of several that even serve beer, much less sell it to go.

99? Where’d you get these pre eld stats at?

I drink on my time off here and there if I’m not at a restaurant and if I’m doing something around the truck and taking a 34 I got my little bbq and beer out chillin.

Another thing is when leo does get a warrant to search your truck, it specifies what they are looking for and where, in other words they can not automatically go into your sleeper just because they have a warrant.
They can open the door and see what ever they can see from the ground, but any lawyer will tell you to tell the law, the dot or anybody else to get off of your truck step if they climb on it.
There was a case some where where a dot slipped and sued the truck company because he fell off the step.

Question 3: Does the prohibition against carrying alcoholic beverages in §392.5 apply to a driver who uses a company vehicle, for personal reasons, while off-duty?

Guidance: No. For example, an owner-operator using his/her own vehicle in an off-duty status, or a driver using a company truck or tractor for transportation to a motel, restaurant, or home, would normally be outside the scope of this section.

The dimensions of the sleeper berth are stated in the green book. Any officer may enter your truck to verify the sleeper dimensions are correct and that they do comply with the regulations. Remember, anything in the green book is enforceable. There is no warrant required, they can simply get into your truck and measure your sleeper and if they happen to see something during the course of measuring, well then it gets interesting.

    Lepton1 and tucker Thank this.
  11. are they buying beer and then leaving out in the truck??
are they just buying beer and sitting there and drinking it while they're not going anywhere for 10 or more hours??
Were you a teacher's pet in school??
