Thank you. I did misstate. The truck is not more subject to a search than a common 4-wheeler even though it is a commercial vehicle. However, like a 4-wheeler, if something suggestive of a crime is in plain view by the cop THAT will give him cause for further search and driver consent is not required.

 

Has everyone seen the YouTube video of a car hauler stopped in VA with cops looking for his radar detector? It's a classic.

 

This, kids, is why you ALWAYS keep the curtain to your sleeper closed while driving. If it's open, it's as much fair game as the forward lart of the cab that's in plain view. If it's closed, they need a #### good reason to open it up and search it

An old trucker wives tale. 393.76 gives all the regulatory authority/reason necessary to “inspect” a sleeper berth.

 

There is a limit to that they can not do a search for any thing outside of the regulations, this means sleeper size, bedding and so on but messing around with personal belongs ...pic has to be invoked and justified,

Probably so (A troll) and you are correct that there are limits. They can inspect for exactly what is in the regs, and the regs do not allow for a search. My comment was mainly concerning his statement “If it's closed, they need a #### good reason to open it up and search it”. They need PC, warrant based on PC or permission to search, but not to open it to inspect it. Then there is the plain view thing.

The us border patrol at the border or within 100 miles of an international border does not need pc or warrant. This is the law, people don't seem to think it is not possible but they have the law backing them with a few court cases affirming it.

Despite denials from local cops, the border patrol is used here to search vehicles when they can't and have been for a while.

 

The border search exception does not apply to roving patrols making stops and searching. It applies only at permanent check stations on major highways.

 

Back when nobody cared about radar detectors, they were always verbotten in Virginia and confiscated.
