Off duty vs sleeper berth

    That's exactly what im thinking. Im currently staying in a hotel for the weekend. (Since I don't have a truck yet.) How would I prove that I stayed at a hotel without a receipt? I don't think its necessary.

    I am ignorant when it comes to how these e-logs are with off duty days. Back with paper logs I just drew a line across line 1 entered my name and the other basic info. No truck number, no trailer number or load number. This is an off duty log and with no truck listed your covered. With e-logs I am sure the same is true.

    He can't because there isn't such a regulation anymore. It used to be, but they changed it so daycab drivers can take their 30 in the cab.
    So you can be off duty in a day cab for as long us you want.

    I would say you can be Off Duty in day cab for 30 minute break or even 1 or 2 hour lunch or dinner. You can't log Sleeper Berth since you don't have one.

    I don't think any reasonable company would take the risk of sending or telling a day cab driver to sleep in truck and log is as Off Duty. To save a hotel bill. If the drive gets in accident and once they figure out what happened the trucking company and driver would be in big trouble. If someone is driving a day cab cross country and don't have any hotel receipts. They will start tracking the driver and try to figure out what he really did. They will start looking at every cellphone tower pings and any video they can find. Credit card transactions calling the friends home you claim you stopped at every night.

    I know. That's what I was getting at. We often see posts on ttr saying something is law that is not. Quote the reg has become my default response to those.

    I understand the point you are making, and in a basic concept I agree. The problem though is there is no actual rule that mandates where you sleep (or not) when logging off duty. This would even be a problem for an Attorney in the case of a lawsuit. To the best of my knowledge, there are no rules that mandate you sleep in a sleeper or a hotel, and further no rules that mandate you actually sleep. Common sense is one thing. However, the absence of rules mandating this is another.

    They would just ask the driver in court were did you sleep ? If the driver says I did not sleep they you. They got you for driving tired or not well rested or some law probably.

    Just like they got the Walmart driver for being awake like 22 hours when he had that accident on the NJ turnpike. His log book was legal and he was at home on his personal time all OFF DUTY time before the accident. Once they figured out what he really did they got him.
