    REALLY bad news...

    At the beginning of this week, on Monday, I got a call from Roehl - to tell me they found 2 misdemeanors during my background check / criminal record - which I didn't even know I had - and that they couldn't hire me!

    I was totally shocked, since I have also had the background check for Hazmat and been cleared. I've also had other background checks for other jobs (NASA contract job) and never heard one word about misdemeanors.

    The first misdemeanor was from a traffic accident I had, that is more than 5 years old.
    What I didn't know/realize is that (in Ohio) every traffic ticket is also recorded as a misdemeanor - and even after the points drop off (for the purpose of insurance) - the misdemeanor on your record - NEVER GOES AWAY... IT'S PERMANENT!

    The 2nd misdemeanor was related to a ticket I got at West Branch State Park, on my boat, in 2009.
    I got cited by a State Watercraft Officer for 'Intoxicating beverage on boat'... which is now 3 years old.
    I waved the fine, and thought that's all it was... just a fine... but it was also a misdemeanor!?

    My fishing partner met me at the lake, and brought the beer with him. We went night (drift) fishing, and then anchored... while we drank the 6-pack of beer he brought. (Alcohol is prohibited in all Ohio State Parks).

    The next day, when we went back to the dock - the state Watercraft Division was doing boat safety checks. My boat passed, no problem. When he asked if we had any alcohol on the boat... he spotted an empty beer can in a cup holder... I said 'no' we don't have any alcohol on the boat. When he asked about the beer can, I made a smarta$$ remark - something to the effect that we 'don't have any alcohol any more'. He wasn't amused. I told him the story - but at that point - he really didn't care. He gave me a sobriety test, which I passed, and gave me a ticket (my boat, my responsibility). My buddy split the cost of the fine with me - which was $150.

    On the bright side, this misdemeanor can be expunged - but will take about 4-6 months before it clears.
    I've already started the process.

    Now I have to go back and contact every other company that I've already applied to, and tell them about this new set of circumstances - just to see if they will still consider me!? Beyond that, I'll have to make sure I put the misdemeanors on all future applications.

    The problem is, that this is considered an 'Alcohol related offense' - and I don't know if it even matters that it was in a boat - or that I wasn't intoxicated - but that it was a fine for having alcohol in the first place?! This has really been a kick in the gut.

    What's more - I rarely drink - or even have any beer (or alcohol) in my home... and never get drunk because I don't like hangovers. If I do drink, it's responsibly - 2 or 3 beers and an hour or 2 before I drive.

    I'm 53 years old, and never in my life had any alcohol related charges (other than this one offense). :biggrin_25513:

    I can't wait to show my friends this post! They all think im so stupid about how paranoid I get with alcohol.... Like I won't even leave my house after one beer or let them drink in my car.. And I won't drink In public or bars. And if I drink anywhere other than my home I crash there. I get made fun of for it all the time. But this post proves that for cdl holders there's no such thing as being to paranoid! This really sucks and those charges are lame. I hope this stuff gets cleared up for you. Keep us posted.

    I just found out at trucking school that if you pop pos for marj you can't get a driving gig for at least 10 years. That will be on your record for at least 10 years.

    Hello, drivers. Really enjoying the forums here. A quick bit of info: I'm in a 3-week school. Passed the written tests last week (including tankers & doubles/triples) and take the road test in a week & a half. USX and Swift recruiters have sent me apps that I've yet to sign.

    18 years ago, when I was 18, I committed an armed robbery and spent 5 years in prison. A punishment I certainly earned. Nothing else on my record my entire adult life - not even a misdemeanor. I received a pardon January 2010 but couldn't get it expunged, so it's still on my record. The only traffic violation was an improper lane change in 2008. I damaged a car's front right quarter panel, but the driver was able to drive the damaged car after the accident.

    Here's my question: Given that my record still reflects a violent crime I committed as a dumb-as-rocks teenager, what are the chances of being approved for the Haz-Mat endorsement? I called the TSA but that was fruitless. If anyone can point me to a source document detailing automatic Haz-Mat disqualifiers (if that even exists in the public domain), that would be awesome. If you know of anyone with a similar conviction from way-back-when, who obtained their endorsement, I'd like to hear about it. I'd hate to shell out the cash if it's guaranteed my money will be wasted. Thanks.

    Just spoke to central and they would not take my wife and I as students because I have one speeding ticket that is 2 months old. No accidents and no DUI'S. Is this common, will we not be able to get a job?
