I got 4 points today. For an overweight warning by Washington DOT.
i was called in to scale, and they said I was 2500+ over on my tandems. I was not, in fact after they wrote out the warning, I had to cross the scale again. I didn't adjust the tandems as they were already all the way back the first time I crossed. Second time I crossed the scale, I weighed in at 33750ish. Too late to take back the warning and SWIFT doesn't seem to care. I had my cat scale from the day before and showed that to DOT as well as SWIFT. Basically, SWIFT says "too bad, they gave you a warning."

Is there anything I can do about this?

Bummer. Sorry for your trouble. I'm so sick of the state and feds looking at us like 18 wheeled cash registers. Why did you have to re-weigh if you didn't adjust anything?

Was one of them fancy weigh stations with parking out back. Told me to park and bring in papers, had to circle around and cross the scale again to get out.

I know CAT scales certify and guarantee their scales to be accurate. Read the instructions on the back to see how to file a "claim". I don't know how far up the food chain you've gone, but I'd get in touch with the Director of Safety or go to your DM's boss to see if it can be resolved. Sometimes you have to keep fighting and appealing all the way to the top b/c not only does that count against you it goes on the company's CSA score if I'm not mistaken.

There is no recourse at all with a Warning. Overweight tickets are not even supposed to count at all against anybody. But a Warning will.

What I always try to do when they try to box me in is ask for a supervisor. I believe they can write you up for anything, but it doesn't mean squat til you the driver sign it.
It's going to take someone with guts of steel one of these days to say 'hey look, I have my cat scale receipt, boom I'm not signing your warning, take me to jail, impound my truck, but I'm not signing anything'.

You said the tandems were all the way back, you sure it wasn't a bridge law violation warning ticket?

Positive. It was in Washington. I80 POE I believe. This was about a month and a half ago, SWIFT just got ahold of me about it today. Reason stated on warning is " over weight on trailer."

I-80 doesn't touch WA! Do you mean I-82, down near Kennewick, just crossing the river after Hermiston?

And the CAT scale ticket doesn't show any proof of tandem position...so they won't help even if you could challenge it....just advertising hype!
