log question. forced to log out early, take a ferry and call in to adjust after

    I have an odd situation. We deliver to an island and take a ferry over with the truck. At the end of the day we leave the truck, log off, add post trip duty to cover the ride back. The ferry company sends the truck back.

    Now the company wants us to log off completely, take the ferry and call them when we get back. At that point they will adjust our end of duty.

    This doesn't seem right legally and if, God forbid, something happens before we are supposed to call technically we are logged off even though still working.

    Am I wrong that this sounds not entirely correct/legal?

    I'm confused, how do you "log off" then add "post trip duty" if you're logged off (and what is post trip duty in this context?)

    What is "end of duty" and what's to adjust?

    Are you in Canada I assume? Are you paid for your time on the ferry ride back?

    When I used to take the ferry from Sydney, Nova Scotia to Port aux Basques, Newfoundland, I'd log on duty or on duty/driving while staging and loading the ferry, after which I'd switch to line 1 and enjoy the comfort of the private rooms or restaurants. Usually my 14 hour clock would be finished by the time we docked in either city, but I'd still log 15 mins for the offload and park just off Marine Atlantic property. Never had an issue with DOT about this practice.

    Also, is it possible to phrase your question in a different manner? I'm having a hard time trying to figure out what you're asking exactly. I thought your logs weren't allowed to be edited by anyone? Never used e-logs but I can't imagine DOT would endorse that practice.

    My apologies. We use xata for our logs. They are having us end the trip before we take the ferry back. Then we call when we get back to our cars and they adjust the time we log off xata from the home office

    You can edit logs. If you can use white out on paper why can't you edit on computer? Well d.o.t say only the company can edit e log

    they have always been able to edit logs for mistakes or a xata screws up. This now will be a matter of course. Technically when we sign out of xata on the island without adding time for the trip back we are certifying that our day has ended though both we and the office know it isn't the case.

    Also there is the matter of technically being off duty and getting hurt before we get back and have them edit. Anyone trust the company to honor us being on duty?

    If you've logged off then that's it. But I can see that there could be a gray area here and it could be a tricky situation. Because if they move the truck via ferry, them how do they explain the move within the framework of the logs. You logged off at point A but when you login again, truck is at point B. Yeah, that's a mind boggler.
    That could be something you may have to explain to DOT. Bet they might have a hard time too figuring out a solution
    nothing is clear cut sometimes. Personally, I don't think in that case it should go against your hours, but it probably will. :biggrin_2551:

    Dr fandango, when we logged out and added post trip duty, that essentially covered our butts when the ferry workers moved the truck. We never ended up in violation.

    Yes, and that's why the co will adjust the logs accordingly. It's a point that could be overlooked by some.
    Certainly an unusual situation. The only thing they can't adjust is the driving time. I was just putting forth the case, and you have the solution.
