vikingswen, have you ever hit the border and had to shut down because driving into the US would make you illegal as far as HOS goes?
My understanding is Canada regulations allow you 13 hours to drive in a 15 hour day, so if you hit the border at your 12th hour you have to shut down, and take a 10 hour break before you'd be legal in the US, is that correct? -
Yes, you will have to make sure you are legal when entering the US. Your reset has to include the 2 periods of 1am to 5am, you need to show 10 hours off duty and you must show your 30min break before your 8hrs on duty were up. The DOT has been known to set up shop right outside customs and check log books. Customs does not check, but you will have a time stamp on your receipt or transponder statement for the $10.75 crossing fee.
Here is what you are allowed in Canada with the South of the 60s latitude HOS: Canada uses a 24hr window.
Daily driving and on-duty time
37.13.01(1) A carrier
must not request, require or allow a driver to drive and a driver must not
drive after the driver has accumulated 13 hours of driving time in a day.
(2) A carrier
must not request, require or allow a driver to drive and a driver must not
drive after the driver has accumulated 14 hours of on-duty time in a day.
You do not have to drive the 13hrs in the 14 hr window.
-
So it would be easier to simply follow the stricter regulation, in this case the US, as to avoid any issues. I can only see driving in US regulations in Canada wouldn't violate Canada HOS.
-
Depending on how much time you have you could only drive the 11hr per day, but when you are in the produce hauling business you have to run every available hour to make your appointments. My goal is to be in Alaska about 12hrs before my first delivery appointment which gives me about 72hrs to get to Alaska. This will give me a cushion for delays and breakdowns. -
We have a 16 hr window as opposed to a 14 hr and we can extend our window by doing a split sleeper berth another big factor is 70hr/7day cycle helps a lot.. Also we need a 24 hr period off in previous 14 days otherwise you could go 10 hrs a day forever on recap... Another thing that trips up us drivers is you need previous 14 days of logs ... Great thread vikingswen
The Challenger, vikingswen and rexmanno Thank this.
