This Doesn't Make Sense (DOT REGS QUESTION)

    Last year I was in accident with a motorcycle. In NC if you make a left turn your automatically at fault. My insurance paid the guy off so the FTY ticket was dismissed. The man was injured... And that seems to be the issue. I have never had a accident in my life... I'm over 30 years old. But one company that I was being hired with says by DOT Regs I am disqualified for 5 years from a CDL. An other company says that is not true. Here are the facts... There was no drugs or any drink involved. No speeding on my end. Just a left turn on a blind curve and the bike tboned me. Is it true I am disqualified for 5 years and a DUI is less?

    Never heard of it. If you cut across the road making a left turn, then probably it will not go in your favor. If you make a left turn from a legal turn lane for a left turn and the arrow is on your side then you would be in the right.

    Did you ask them to give you the source of the DOT Reg as in what part?

    I've never heard of this.. I don't think it'd be correct, for a DUI for drinking was only 3 years, know a guy who got a DUI 2 years before he got his CDL and they kept it inactive for 1 extra year, but alot of places do things on a case by case basis. Wrecks happen all the time, I dont see why this would be any different, since you say no drugs or alcohol involved, Most everyone would be dismissed if they'd ever have a wreck in the last 5 years in a car means they'd be fired, I'd say the companies excuse for not hiring you, as an easy way out.

    It was a T- Intersection with a blind curve. Made a complete stop and as far as I could see it was clear. Made my turn... Bam. It was a failure to yield but that was dropped when my insurance paid him off. But the whole thing smells funny. All I can find is NC saying 2 major accidents in a year.

    On this one accident you had 2 issues that would affect future employment, one being the Failure To Yield (FTY) ticket and the other being an accident with personal injury.
    Since the FTY ticket was dismissed, it won't be on your driving record, however that personal injury accident will, and THAT is what will affect future employment.
    There is absolutely no "DOT reg" that would "disqualify" you. (If someone knows of one, I'd sure like to see it.) Nor is there any "5 year disqualification".

    What affects your "eligibility" with any company is typically controlled by their insurance company, so it's often not just the trucking company's decision.
    Being as this personal injury accident is only 1 year old, it will have a substantial bearing on MOST trucking companies.
    So be prepared to be rejected my many, but not every one. Personal injury accidents do have a larger "black mark" effect than property damage accidents.

    Here's your answer; Contact your state DMV or MVD and ask them. They can tell you for sure.

    One company will hire me... Just wanted to make sure I wasn't wasting our time or money. I tried the DMV... keeps going to a voice mail and the have never called back.
