#1 Was this a Trooper or county-city cop?
#2 What record is the refusal on? MVR,DAC,PSP?
#3 The lawyer screwed you....the reckless is really bad!
Either way driver you really messed up.
I have done some dumb stuff in my 4 wheeler over the years and paid many attorney fees but at any cost do whatever it takes to keep your record clean.
I do know only SC troopers report to the FMCSA....or they did a few years ago.
Tell us the full story....are these companies you are trying to hire on with finding this info out or are you telling them from the start?
NEED to pull all of your own records and seek further legal advice.
Would this show up as a refusal on my reports?

Honestly the story between the lines seems to be.
I got drunk off my arse ended up in a car drove some then passed out, Don't remember a #### thing and the next thing I know a cop is banging on my window, I stumble out of the car smelling like booze. Cop then plants boot up ones arse and takes me to the happy house.

South Carolina Reckless Driving Statute and case law:
The offense of reckless driving S.C. Code Ann. § 56-5-2920. relates to any person driving any vehicle in such a manner to indicate a willful or wanton disregard for the safety of persons or property.
Recklessness implies the doing of a negligent act knowingly. When a man actually acts negligently and he realizes that he is acting negligently, the law says he is reckless or willfull and wanton, whichever term you prefer, they all mean the same thing, that is, the conscious failure to exercise due care. State v Rachels, 218 S.C. 1, 61 S.E. 2nd 249 (1950). It is not necessary that a person violate a traffic law to be guilty of reckless driving. For example, a driver who continues to drive after dozing off at the wheel, disregarding the fact the he is very sleepy, has shown a wanton disregard for the safety of persons and property and is, therefore, guilty of reckless driving.
In any event, he would have had to fall asleep WHILE DRIVING to have been convicted of reckless driving.
