I don't understand why people even watch shows like that. I tried watching John Stewart and after about 10 minutes had a migraine headache. Just a bunch of blah,blah,blah silly talk that doesn't make sense. Maybe it's me; not smart enough for that level of entertainment. Just like Rosie O'Donnell; became a millionaire by being the most obnoxious woman on TV and Americans love her. 10 minutes of watching her and I considered giving myself a lobotomy with a shotgun.

Never listened to Stewart, never heard of him. But I tend to keep my hands clean of politics. I don't have much respect for people who do little but flap their gums.

Yes, it is...and happens quite frequentlly. For example, a few years ago the FMCSA mandated e-logs for the "bad actors"...companies with chronic HOS violations. OOIDA sued. FMCSA lost. E-log mandate went away. FMCSA is. Trying again, will be sued again, with the same outcome because the reason the 1st attempt at a mandate was rejected still has not been addressed. Remember the whole "can't start a restart until 168 hours (7 days) since the beginning of your last restart" thing? Tossed by the court, along with the requirement for LOCAL treucks to take that silly 30 minute break. Every "update" to the HOS for that matter has been challenged in the courts by trucking groups or "safety advocate" groups or whoever else thinks they have standing to bring suit, usually resulting in another "update".
The FMCSA would have a lot more money in their budget for the important things if they'd just learn to stop fixing #### that ain't broke so they wouldn't have to spend all of that time and money in courts and legal expenses defending their ridiculous mandates...but that's government for you. When they start running a little low on funds, they just reach right into YOUR pocket a little deeper...and if that STILL ain't enough, they'll take it from your kids & grandkids, too.LGarrison, Vilhiem and KANSAS TRANSIT Thank this. -
The 168 hr restart limit wasn't stopped by a court decision, it was stopped by a smart legislator who added a provision to suspend it to an existing bill, it is suspended until a completion of a study to it's effectiveness on safety.
As far as electing the same people over and over, what does that have to do with the DOT or FMCSA? They aren't elected. And until recently, no one in congress has had the courage or the intelligence to put any restraint on their authority and rule making. Just recently some congress member got the idea of making them go thru congress to get new regulations approved before they apply them to us. But then, like the President, they use procedures to go around the congress with procedural bulletins and advisories to the DOT approved doctors bullying them into using their non-regulated guidelines as if they already were regulations.Last edited: Aug 8, 2015

...I stand corrected. I knew it had been challenged, and I knew things had changed, and that the short haul was exempted from the 30 minute break by the court, and assumed the restart provision changed then too.
Too much happens too quick to keep track of the when/where/how of all of the changes...Mr.X Thanks this.
