The way that would work at my company is that the first driver would be the one to get burned for the overweight trailer.
I don't know how it works in Ohio and Indiana, but some states write overweight tickets to the company, while others do so to the driver.
The second driver would have gotten ticket, but the first would have been held responsible for the fine IF his terminal had an operable scale, and much deservedly so according to what I've just read.road_runner Thanks this. -
One of our drivers got a $1300 ticket. He had to power swap his twin screw for a single axle. Our barn did not have a working scale. Our company picked up the tab

No. 2400 lbs over on his drives. The officer refused to even let him correct it before he issued the ticket. The driver ended throwing his chains in the back of a trailer and hand tossing a bunch of freight away from the nose

For those who drive single screws, beware when you see your truck with new tires all around. You'll be fighting to keep it on the highway for a few days.
