I don't have a dog in this fight anymore, but I would like point out that the discussion got started by @CJndaTruck, he does have a dog in it and simply asked a question. I think it is a valid question to ask, might be better to ask it in Louisville before signing, but it is a valid question.
Companies that we lease to are the ones that hold the contracts for transportation of goods, we sign a contract with the company to move the goods they have contracted to move. The contract we sign is between trucking company and ourselves as equipment owners for payment, not between us and the shippers.
One of the reasons I have never ran my own numbers is for this very reason, I have always been told that I will receive payment wether the company does or not. It is their customer, their responsibility to go after them for payment if they do not pay. I have no recourse to be able to go after the shipper because I never had a contract with them. So why should I be liable if they do not pay?
I understand y'all don't believe Mercer would hold you liable, I wouldn't think they would either, but then why put that in their contract? Is there not a better way to prove that you're not employees? I'm not a fan of, " Yeah it's there , but we'll never use it.", if it's there they can use it. Perhaps they're considering letting you guys go after your own freight?

Gee guys. I was just asking a question. I never said Mercer hasn't or won't pay. If you all want to jump on me for asking a simple question then go ahead.
I have not read the new contract. I know some have. What I read was a Mercer driver wanting to leave and go to LS over it. And I just wanted to know if it was a valid complaint or not. Like I mentioned it would make more sense if we had more room to pick off outside boards and expected Mercer to collect for us. But I was never trying to start an argument.
Anyway, I need to go burn a little more wood before the house cools off. Thank you for answering my question about the new contract, sorry I started such an uproar.whoopNride, taxihacker66 and MarkH83 Thank this. -
Imagine that, someone came on a Mercer thread and commented on a Mercer issue. I see nothing wrong with CJandaTruck's question either. I've always been paid every penny I was owed by Mercer, & nobody on here accused Mercer of screwing them, or potentially screwing them, a back charge comes from someone screwing Mercer. I haven't seen the new contract, or heard anything about it until reading here, so I'm actually glad he came on here and mentioned it.
