When TX DPS gave me warnings, it was on paper kinda like a adding machine paper.... except a little bigger. Its a written warning printed by a printer from his laptop computer in his patrol vehicle.
Written warning worse than an actual citation?

The only way to challenge a Warning on a DOT roadside inspection is through DATA Q's
And it is the same as guilty! -
Myth. always prefer the warning over a citation.
(Employment application, and annual license review. When listing tickets, guilty citations are listed. Dont list citations that are dismissed or where there has been no disposition,)Last edited: Aug 15, 2016

You can DataQ a warning just like you can a citation.
-
Apparently you've never gotten an inspection with the warnings listed.scottied67 Thanks this.

here never shows up anywhere. We would write a warning and one copy went to whoever it was written to and the other filed away at a local troop office.
-
That too is true....but once points go on the CSAmerican or PSP, even if you where to beat the ticket, the DOT does not remove them. The DOT considers those kinds of points "non-punitive". So they don't think they should remove them, even if they are erroneous.

If they write up an inspection form and write a warning on there for say unsecured hazmat or a 1inch by 1 inch piece of old placard and called it a warning for improper placards, yes those will be listed on your PSP report for the next three years even though they are just warnings.
It can spike the carrier's CSA score and in turn cause you to lose your job or at least trap you in the job you're in and cannot get a driving job anywhere else for a couple years.
I don't believe you can dataQ a warning off your record. When this CSA 2010 first came out cops were writing warnings like crazy 1. they knew there was no way to fight it, 2. some of them thought they were doing us an actual solid favor. -
If you tell a cop that you want a ticket instead of a warning then you are officially an idiot.

Get ahold of any of the 1-800 traffic lawyer types you see who want to do payroll deduction every week, they will tell you always fight the cops for a ticket over a warning.Bean Jr. Thanks this.
