As an OTR truck driver I asked at least 1 week ahead of time on 3 successive home times to get home for a doctors appt. I'm the 3rd time I was in Montana and needed to go to Omaha and Dispatch was sending me to Idaho. I told them again that i needed to get to Omaha and could not get there in time by going West. Soon, it came down to me leaving the truck in Montana, per company directions, cleaning out what I could, packing a rental car and heading home-leaving the company. I took photos of all Qualcomm messages about the doctors appts.
I filed a small claims to get my refrigerator and stuff back. They now want to settle out of court for money and my stuff back. Good idea?

I guess it all depends. See you are vague on a few things, don't need to know it but why did you have to go to the docs is one area, another is why quit.
I would have told them that my doc is helping me maintain my CDL but that's me, it may not work with a company who keeps people moving away. I would also escalate the issue beyond dispatch, not knowing much about these companies now and not caring to know, i can't see where there is a wall that stops a driver from talking to someone in management to get some help resolving an issue. I guess many drivers don't get into who's who in a company outside of the two or three they have to deal with in their job.
So my advice, for what its worth is ... If they want to settle, see what they offer, if it is getting your stuff back (or compensate you for the costs of the stuff) to you at their expense, fine do it and end the problem but if it is pennies on a dollar, it is a gamble which way it would go in court.x1Heavy, Pnwtrucker and Dominick253 Thank this. -

So the company wants to settle a claim by paying for and getting drivers equipment back, as long as it is a reasonable compensation take it and be happy. Should you decide to take it to a court hearing you will lose. In your OP you state that you had given a week notice to make home for an appointment. In most situations, non emergency medical appointments are at least a few weeks out. You knew about the appointment long before you said anything to your dispatch. That will be your undoing. you had information and did not provide that to others in order to plan accordingly.
So you have done this to yourself. It seems the company is being reasonable, they rented you a car, they are offering to reimburse your property loss and or returm property.
As for the termination, clearly they thought it was in the best interest of all paries to separate. And truthfully, I would have done the same, only I would'nt have waited so long.Last edited: Jan 7, 2017

Unfortunately this is one of the reasons that a lot of drivers are in poor health, and have a reduced life expectancy compared with the rest of society.
I've cancelled numerous appointments this year - and I own the truck. How to schedule something 3-6 weeks out - when I never know what I'll be doing then.
Turn down $1000 - $3000 of revenue for a 30 minute appointment?
