    Yea this being my 1st full year in the industry I wasn't exactly sure what would be best for myself. I'm anxious/curious to get my w2's and go sit down with an accountant, and figure out what's best for me going forward.

    If I didn't take per diem then that extra money was just going to go to the ex to use for new shoes, etc for herself instead of the kids so either way I'd be getting screwed lol. Rather be screwed later than right now and plan is when I finish paying $300 a week in support I'm just going to start stashing that $ into retirement account since I'm used to living without that $ already.

    Keen I hate to tell you this but if your EX demanded a review of your wages for Child Support your Per Diem would be considered Hidden Income from her and your butt would get hammered by the Judge. I have a neighbor who was trying that to hide income from his ex. She demanded thru the court to see his Pay Stubs they saw the per diem on it. He had his Child Support go up and was found in Civil contempt by the judge for that crap. The Courts do not care if it is not declared income if it is on your pay stub which as per IRS rules it has to be listed on there and they find out about it your screwed.

    I've been told as long as I keep receipts for all purchases while on road and can show the courts the amount of $ it costs to perform my job and live then courts won't touch it. I've spoken at length about it with my attorney, and since it's on paystub I'm not hiding anything. I'm sure every state/county is different though

    He is not talking about personal expenses, that is itemizing. He is talking about how The IRS, banks, etc view your income. Millis pays that per diem portion money to you tax free, and you end up paying taxes for it at the end of the year.
