TN resident OTR for IN company they withheld state tax.

    I live in Tennessee, we have no state income tax. I went to work for a company in Indiana as an OTR. They withheld state taxes from my pay, stating when tax season came I could get the money back. I looked back from when I worked for a company out of Mississippi and the other out of Iowa, neither withhold taxes because I didn't live there. Federal taxes are complete, do I file a non resident with Indiana? I am at a loss of what to do. Thank you in advance for you time and help.

    I believe you have to. My Dad is a captain for a private jet charter company in Sellersboro I believe is the city and he pays taxes in Wisconsin his home state and Indiana

    I worked for a Company that had a policy of withholding taxes for every state we earned commissions from. I had to file income taxes in those states, my record was 29 states in 1 year, my CPA had a field day with the fees.

    I would just ask a CPA, it is easier to get a straight answer, than to guess what to do.

    Yes, file a return as a non-resident worker. sorry that company does that to you .

    At one time we lived in PA but wife worked in MD. We had to file both states.

    My last job I lived in MD, but worked in MD, PA, WV and VA. Only ever had to file for MD.

    Since the company has already taken the taxes it would seem to me your only choice is to file in that state to get anything back.

    But again.....ask a CPA who actually knows. The tax code is tricky and not something to play with.

    Could you imagine the mass confusion that would occur if an OTR driver had to pay income taxes for the hours spent in each state each year.

    You will need to file an Indiana state income tax return, claiming non resident status and you will receive a 100% refund.
