Actually the test is, would a reasonable person in that situation have done what he did? Would the average 23 yr old green card trucker from TX have faded his brakes on that mountain? Sadly, yes and stories here on TTR about smoking brakes are a testament to that.
I see worse acts of negligence every day all day. Riding the bumper of a minivan at 70 mph in the pouring rain is a clear cut case of vehicular manslaughter waiting to happen but I see it all day and the cops do nothing usually. They should be charged with careless driving

He was driving down the shoulder at one point. There is a YouTube video showing him blowing past stopped cars.
I suspect he was forced into traffic shortly after that by Jersey barriers or bridge pillars.
I do not know that stretch of 70 very well, but it is not hard to imagine miles of barriers or zero-shoulder preventing him from safely getting an out of control truck away from the road.PoleCrusher and rank Thank this. -
