With so many agencies going to digital communications i doubt if any of them are not encrypted now.

Some states have laws against them. A Ky dot spied my vhf radio and ask if I could listen to law enforcement. I told him I possibly could depending on what frequency they were on, so he determined it was illegal for that reason. I told him it was not programmable (which it was) so unless there frequency happened to be a channel programmed in there (unlikely) then I couldn't. Then he decided it was illegal because it was a ham radio, well I ask if it was illegal to own a ham, or use one, and the answer was to use it. I then explained, it was not even powered up, so apparently I just own one, he laughed and told me to get out of there.

I had one long ago.
A little bearcat. Hear everything from Aviation Center all the way through the occasional railroad on down through the older cellphone and so forth. Even the occasional DOOM nuclear authentication around 265 mhz or so from a B52 somewhere.
What I don't hear is very much police. I can get that over the internet.
Frederick, everything from KDFK to Sheriff and ongoing hazmat incidents as I type this.

Why bump this old thread.
In most places it will not be illegal.
I have 3.
Anyway it wouldn't be that great when traveling long distances.
Moving from state to state county to county and highway patrol troop to another.
It would be best just to listen on your 10-hour break.
But yeah in more and more places are switching to trunking and digital, which is monitorable mind you but very very expensive.
A decent TDMA Digital scanner will cost $400-500+.
And that's not even having a decent antenna.

I was eyeing the SDS100, but it is ike 650.
Also I would advise not to come here looking for information on scanners.
Same way you wouldn't get car advice from the salesman at Best Buy. .

Can anyone update this for today date and legal/illegal use?

Most, if not all states that make mobile possession illegal, make an exception if you have a ham radio license.
You also have scanner apps for your cell phone so you can hear over the internet but they dont cover all police depts -

Police are switching to digital, and using encryption. They might even use cellular service, I see AT&T is advertising a special "first responders network", maybe they'll get a certain partition of the G5 network. -
Or you can stream the local police scanners from your smartphone.
