3 years work history

    A company I applied for requires 3 years work history (After graduating with Class A) and self employed-requested three years tax returns and supplied and then asks for LLC formation. Not sure of the employee isn't smart to know how to handle a self employed situation.

    I would find another company. All they need is to document the gaps by your statement and that's it. They don't need tax returns or anything else, just a statement about the gaps.

    I do not have any gaps. I have been consistently self employed either through my spouse or opening a joint business with my spouse.

    .... not related to question , but i've seen people use out of business companies (ie- yellow freight ) as a previous employer .

    Sorry I wasn't clear. So read this - these are considered gaps for traditional employment, so you need to make a statement (affidavit) of your employment for the time period in question. I would have it notarized and send that to any potential employer, this fulfills the FMCSA needs for employment verficiation. IF the FMCSA needs more info, not the employer, then they will contact you THROUGH a letter and ask for other means of confirming your employment. The potential employer is supposed to make an attempt and then ship it off to the FMCSA if there is nothing from the previous employer. The regulations do not have in them that this has to be verified to the extent of checking tax returns or anything else - that's utter BS.

    If I may. Let's remember part 391 breaks work history into 2 sections. A carrier is supposed to have a "general" work history of 3 years and if the applicant has a CDL up to 7 years history as a driver before that. Because the FMCSA has such a heavy hand most carriers require the applicant to dot every I and cross each T when it comes to 391.21(b). They tend to reject an application when they have issues with FMCSA-regulated carriers when they don't return the requested information and won't follow 386.12. Or there is a break in the work history. The problem is there is no regulation that prohibits breaks. The rules simply state breaks have to be accounted for, THAT'S ALL!!!!!!!!!!! Just recently I was talking to a good friend who did this. All you have to do is contact the closest FMCSA service center and let them know an FMCSA-regulated carrier is not supplying the REQUIRED information. They will either light a fire under that carrier's arse or will write a letter on FMCSA letterhead that can be placed in said driver's DQF and FULLY satisfy part 391.

    I’m not sure what the issue is.Your tax returns must have reflected the LLC so for them to ask for paperwork doesn’t seem outrageous to me.Some companies want verifiable information.For example I ran on my own authority for 17 years I had a friend for the majority of the time who constantly quit jobs he had a family so occasionally I would let him take a load with my truck and trailer and I would take a week off so he could make money and I could take time off.but he wasn’t an employee by any means.Several times when my friend would put applications in he would call me to ask if I would say he was working for me for the last 5 years or so he didn’t have to use the many jobs he had quit from in fear the company wouldn’t hire him. It wasn’t the right thing for me to do but felt bad for him and his family which he has 4 small children.Now that being said some companies would not take me as a verifiable company even though I had a established authority because my business address was my house and no separate phone line in the business name.

    Okay but as you know an LLC is not needed aspect of most businesses. Its just to try to protect the business against lawsuits but we have been operating our businesses without an LLC for years and when we purchased a home we thought it a good idea but then we decided to delete the LLC because we did not feel a benefit. Its a false sence of security many businesses assume they are safe with filing an LLC. Prior to CDL School we deleted it.
    What happens is a person was a stay at home Mom and wants to get into trucking? They cannot get a job?

    OH Is the employment verification fueled by the FMCSA? I did create resume and sent to the employer as I was baffled by their delayed response to get me employed. Seems excessive to me but if this is an actual requirement from the FMCSA that would be surprising. I appreciate your input. The Government knows we always pay our taxes.
