They do have to create a CVSA inspection report, yes.. There is nothing on his PSP unless a trooper did an inspection. I was simply ignoring that as he obviously has no idea what the PSP report actually is. Or what a lawyer can do for that matter....

I don’t think “it passed the coast test” makes it a legit pretrip.
Nothing beats simply looking in the mirrors. If you ever see me pulling out of a spot you will see me swerve left and right before pulling away. No it’s not because I’m drunk, I’m just making sure my wheels are spinning. That has nothing to do with a pretrip or what the dot says I should check, that’s just something I do. Every time.
I mean come on, the Dot doesn’t say your doors have to be closed but you don’t go driving around with your driver door open do you?
With that said, I don’t think the company should have called this a preventable, that seems a little unjust, but no way is the OP without responsibility on this one.HoneyBadger67, Odin's Rabid Dog, truckdriver31 and 1 other person Thank this. -
A motor carrier has no authority to negatively affect a driver's PSP report. They wouldn't want to do that anyway since it would incur negative CSA points back onto them.
I think you are meaning the DAC report that motor carriers keep on all drivers. The DAC report has very little influence on your ability to get other driving jobs.Long FLD, truckdriver31 and Doealex Thank this. -
The OP spent 2 paragraphs describing how horrible the conditions were. And then claims to check for free movement, but then says well he can't see all of them. You can't have it both ways.
We had a driver try to pull a trailer away from the dock, his tractor wheels were on ice. He destroyed the power divider and everything in the 1st differential. And we did advise future employers why he was discharged.spyder7723, x1Heavy, HoneyBadger67 and 4 others Thank this. -
If the driver had his C/B on He would have had many drivers on 19 telling him he was sliding trailer tires and many more telling him of tires skidding before he got out of T/stop lot and made turn into ex/way?

A full 34 and you didn’t have enough sense the following morning to check the trailer? You had a whole day to check it out. It’s not against the law to check on your equipment while you are on a break.
And those tires don’t blow that quickly. You had time once off the ice to check tires in mirrors.
