accident not at fault, reportable?

    I haven't been doing this for decades, I'm still a rookie honestly. But I believe a lot of yall are overthinking this. Dont get me wrong I understand yall wanna be on the safe side, but I for one wouldnt stress myself so much over it. Then again I know I'm a mom & pop carrier kinda guy so again I've never had the slightest issue with accidents I wasn't found to be at fault in. It's not that serious

    I can't disagree. That is why I made those follow the questions comment. This advice is the best advice I know to give in this area. Keep it simple. Don't give information not asked for, but truthfully answer what is.

    it was towed away as you say, that is a record-able accident.

    does it show up on your DMV?

    how about your company THEY HAVE that listed in your company files.!! they WILL TELL a potential employer!

    you fail to mention this accident, you run the risk of not being hired.

    I am not sure who you are directing that comment and link to. I can only guess you are trying to use this to bolster your first comment. If I am wrong please accept my apology. This post-accident testing is still not reported to the FMCSA. It is only even reported into the MRO database if a test is asked for and the driver tested positive. This relationship between Authority Holders and the FMCSA is not something the average driver is exposed to. Honestly, they spend more time complying with things like IFTA and state permits etc. In fact, in almost every case it is the FMCSA that contacts the carrier. The most dreaded contact the FMCSA can make is when the inspection data gets so bad the FMCSA issues something like this. They try to stop things before they get that far, but sometimes, unfortunately, those orders do get issued.

    On the subjects of reports to the FMCSA, it is the states themselves that most of the time get a carrier into serious trouble, and they do so routinely. About 3 years ago, Virginia, finally had an (out of state) carrier shut down because of such an accident. They actually sent a team of state auditors in and found the carrier's records were a shambles. Within several days the FMCSA fined them and gave them a compliance date. The carrier failed to comply and the FMCSA yanked their numbers. The moral of this story is simple. If there is a serious accident that driver and their carrier had better have their (redacted) in one sock. You most likely will have an Attorney, The state and locals and finally the FMCSA coming after you.

    When I swapped from tankers to landstar I told them about the guy who was texting and driving and crashed into the back of my tanker police say 90+ in a 70
    Car looked like I had been stopped and he rammed it, hood mashed to windshield.
    I was not at fault, nor ticketed, but I wad truthful, and they appreciated it.

    Got me get a level 1 in the shoulder by TNdot, they said, “You got a blow out and missing mudflap.”
    I said, “Mudflap is in his passanget seat, rest of my tire is on the shoulder where he rammed me.”
    Made service truck fix it, guys insuranxe paid,
    But they didnt drug test me, no deaths, but when I got to terminal the next morning, they made me go get drug tested.
    When that guy hit me my truck was governed at 70, my liquid surged forward and shoved me to 82, and I had to steer myself out of a jackknife.
    My lawyer has my copy on file from dash cam, so does previous employer.

    Nothing ever said about lawsuit, due to that video.
