Are Mexican carriers subject to CSA 2010?

    Very true, if you have control of the truck. What if it makes it back to Mexico? Companies / individuals that break one law will have no reason not to break others to CYA.

    The FMCSA and DOT are proposing that they pay for the EOBR on Mexican trucks under the guise they would control the data. They have been advised by the House of Representatives and the Senate that no tax payer dollars may go to this program. If they try to take from the Highway Trust fund they will lose the amount of dollars from their budget. This deal is gonna go the House and Senate and they are not at all receptive to this deal. If Mexican carriers want to operate here they will install and pay for the EOBR's which is the way it should be. The DOT and FMCSA are just examples of Fed agencies out of control with taxpayer dollars. LaHood better watch it, that representative from Oregon is no friend of the Mexican truck deal anyway and they can refuse to fund any pilot programs by the DOT. When they start these hearings on the program it's gonna be fun to watch. Obama made'em mad anyway by announcing the truck program before they had a chance to study it. EOBR' s will eventually be required but because of the climate of the economy and Washington spending dollars the funding for the programs are gonna be hard to come by and the House and Senate hold the reins for it.

    It is precisely why we have to pay for their EOBR's is because they are not *required* here (yet). It's a NAFTA thing. Cannot require the canucks or our friends south of the border to have things above and beyond what is required on American soil for American drivers.

    What does this have to do with using Taxpayer dollars to pay for EOBR's on Canadian or Mexican trucks. The problem is not the EOBR's it still begs the question why should taxpayer dollars be used? If they want to operate here than pay for them with their money not ours. The DOT has a proposal that all CMV"S will be equipped with EOBR's by 2014 and the Transportation Committee already sent a letter to LaHood that because it's a pilot program don't expect any funding for it. They shut it off once, I hope they do it again. Plain and simple if the Mexican carriers want to operate here than they must equip their trucks with EOBR's at their expense. I guarantee you the DOT and FMCSA aren't gonna pay for American companies to equip their trucks with'em and that's what's wrong with this deal. The transportation chairman said so to in his letter to LaHood. Tried to find that link but it says it has been removed. I figure they'll threaten and fight about this but eventually they'll get their way.That don't make it right.

    The U.S. Department of Transportation will require and pay for electronic on-board recorders with global positioning system capabilities on Mexican trucks participating in the phased-in cross-border program.

    During the previous pilot program, U.S. stakeholders were concerned about potential hours of service violations by Mexican carriers, according to Candice Tolliver, communications director for the Federal Motor Carrier Safety Administration.

    The EOBR with GPS will aid in monitoring Mexican carriers, but the agency must consistently monitor these EOBR devices.

    "And the best way to achieve this high level of oversight is for the United States to own the devices generating the data on Mexican carriers," Tolliver said. "The alternative would limit FMCSA to on-site compliance reviews for obtaining safety-critical hours-of-service data."

    Congress will give its opinion on the program, but its approval is not necessary because the two nations have reached agreement, according to Mexican cabinet officials. They said they expect the first participating Mexican carrier to enter the United States in July.

    Still, a Mexican embassy official has said the first crossings aren't anticipated to take place until August or September. The two nations will sign the trucking agreement between May and June, upon conclusion of a 60-day consultation period in both countries. That period will include participation of the Teamsters union, Congress and the U.S. business sector, he said.

    The DOT Office of Inspector General's February 2009 report on the first cross-border program recommended a cost/benefit analysis on installing GPS on participating Mexican trucks. The FMCSA's 2007 $500,000 contract with the Department of the Army was to obtain and install a GPS on participating trucks and have access to the GPS tracking system.

    That will only happen if Congress approves the money for that. If the Congress tells the DOT no $$$ they aren't going to get it. They shouldn't either. There is no way the TAX PAYERS should foot the bill for this.
