    My lawyer takes 25% of anything she does, so can you imagine 1 lawyer on this. That would be almost a $10 million payday, while the driver gets screwed..

    You forget one important thing sometimes its more than one person, often its a team of lawyers. Sometimes you can negotiate a little for a flat rate and settlement. I have a team of lawyers, not the garbage companies sell their drivers.

    KAG West was sued for not paying overtime, no breaks or lunches. KAG pays by the hour with less than 1% of trucks going out of state. I got around $15,000. Everyone thought that OT and paid breaks were on the way!!!


    But why would they? They would have had to pay me close to $65,000 more if they did that. Being sued every 5 years or so but saving $50,000 per driver in that time. That’s a good way to make more money.

    • $65,000 if I was paid OT, Breaks, Lunch

    • - $15,000 Paid to me from lawsuit.

    • $50,000 Savings to the company.

    This is why nothing will change.


    With Fuel truck you cannot be relieved of responsibility anywhere other than a safe harbor. That is why lunch and breaks should be paid.
