Can a company charge for

    It seemed that removing the weight allowed by that tire, the weight now exceeded the allowable weight. 34,000÷8=4,250. So now having only 7 tires, max allowable 27,750? More than that would be overweight.

    I made a post a few weeks back regarding a similar situation, this company is out of Illinois, and is a w4. My husband has kept his cdl, medical card current and twik card current. He has not driven in 4 years & wants to go back OTR. It is hard to find someone that will take him on because 4 yrs ago ended in an accident in a parking lot, no injuries, no tow aways, his fault. Even companies like Swift and Schnieder told him they want 6 months recent to hire him. He does not want to go with them, but hes trying to get the recent experience somewhere and this company will. BUT the company wants him to sign a contract that for every neglegent incident or accident that he would have to pay up to 2k of his own money. They are also requiring a 1k escrow, by taking out $50 week for 20 weeks. Also, they want him to fill out two w4s. Is that common? The state we live in and the state the company is in. He will be an OTR driver in 48 states. This is not a 1099 job, they have been in business for 17 years. FMCSA is satisfactory. approx 80 trucks. If he is a company driver, he will not be able to claim expenses. What if he dishes out money for any incidents or accidents? Anyone with this situation?

    Don't do it.

    Don't let anyone "normalize" the practice of "escrow." Ask them to show how their withholding of an escrow falls ithin the legal definition of an escrow (it won't).

    Where do you live? There are smaller companies that can take him on, pay him well, not require money held aside to steal, and treat him properly. Maybe post in the seeking employment sub-forum here to see what comes along.

    Only if it's clearly stated in a signed contract that he agreed upon.
