Can I be charged for a load that I did not agree to pick up?

    You can be 1099 as a driver, but they cannot force dispatch you as an employee, and a few other things.

    if you have no intention of ever doing anything 100% on your own I would just stay w2,

    If this story is true, which I have my doubts, how the hell do guys even get wrapped up with people like this? If it is true do what fff95 said and make sure you document everything including you dropping the truck at the yard with an empty trailer with pictures and video.
    Don't expect your last paycheck.

    I'd report these people to the IRS and raise as much as hell as possible myself but I wouldn't get wrapped up with some 1099 bs. Go join a mega, at least the screwing they give you will be on paper.

    People don't want to pay taxes and try whatever they can to avoid it. Then they find out after getting screwed just way we need taxes.
    As for reporting them, it won't matter. Even if the IRS tries to do something the comapny ill close the doors and open under a new name he next day.

    That's true, because they will never be charged or deported they will continue to plague the industry. Will only get much worse actually.

    Just an fyi, if you are considered a independent contractor, outside the fact of a lack of a bonified contract, you as an independent contractor has the right to refuse or ignore any work that is offered without retaliation.

    retaliation is charge backs, fines or fees.

    no matter what they say, this is another pos owner and deserve to have the state labor department and irs go after them.

    File with your state’s labor department that you are improperly classified as a ic and want to be considered an employee, and see what back wages and taxes are due to you as this, and file with the irs at the same time,

    We constantly see stories here where someone is 1099 and they have been taken advantage of. I am sorry this happened to you, but your option is limited to suing him.

    Was that one hour enough time to get to the load, if so could the load have been loaded and then you do a restart?

    You cannot be forced to move the truck if you don’t have the hours to legally do so. I would advise them that if they charged me for the load that I would be going to the state labor department….

    Then you better look for another job because they’re going to want you gone, and don’t accept another 1099 position unless you own the equipment.

    No contract but you're working as a contractor hence 1099... Id find some other outfit to work at before you ruin your CDL with violations/tickets
