    I didnt deny the gap insurance. I paid for it at time of purchase.

    then you should be covered for the balance on the car...but again, lawyer up. it's quick, painless and he/she knows how to squeeze every drop of blood out of the other guy and his company.

    many others here have been advising this besides me.

    if you don't lawyer up, to PROTECT YOUR RIGHTS, then good luck to you.

    we would be wasting our time to continue with this thread.

    I am pretty sure gap insurance dies with non payment of the policy, just like liability.
    The op did not recieve a citation for no insurance, therefore the trucks insurance has no idea that his insurance is expired. There is no injury to sue for, so settling with them while it is always a hassle, but they will settle quick if a guy signs off on any further suits without getting a lawyer involved. Just tell them you want your vehicle and any currant medical bills, ambulance ride, etc covered. They will be more than happy to hurry up and cut you a check.

    An adjuster from the truck's insurance company should contact you. Or you might want to reach out to them. DO NOT AGREE TO TALK ON A RECORDED LINE. Simply say I do not agree to be recorded.

    You should get at least full value of your car's I'm guessing about $8000. And any rental reimbursement.

    Not exactly true but close. About 5 states have the Contributory Negligence law on the insurance books. Alabama and Virginia are 2 of them. If any part of an accident is at 1% or greater fault of both driver's you can not sue the other party in civil court.

    I found out the hard way on this. Ask your insurance company if you live in a Contriborty Negligence state.

    So i talked to a few attorneys and they said it will not go to court due to no injury but no one will take the case so i cant attorney up. They said their insurance company will call me and they will reach out to me but im lost as all hell. And police report is in. 100% his fault... I called their insurance and they said the company needs to contact them. So what if the company doesnt contact them?

    you called all the wrong attorneys.

    and you have to stay on top of this with them (the guilty company). and they can put you on "ignore"..

    seriously, find another attorney and complain about some pain.....

    is it fraud..??

    not if you start having headaches or muscle pain as you tensed up just before the collision.

    I am not certain that this fellow wants to invite attention.

    At the same time, if the OP received no citation at the accident scene, I would, honestly, simply shut up and only start talking to lawyers if he gets summoned to court.

    If the law did not notice his lack of insurance, the absolute LAST thing he should do is get an opposing lawyer looking at him.

    In addition. If there was no citation for driving without insurance, I would suggest also asking the mods to delete this thread, and never mention it anywhere, ever again.

    What company needs to contact them. Anyone can file a claim against their insurance. I have found the best way to get them on the ball when they are taking their sweet time, is to call his insurance company and ask them where you can get your rental car, generally someone will come back within an hour with a low ball bid on your vehicle. now negotiations have started, and they do not have to supply you a rental once they have started negotiations, but will set a date to look at your car.
