Max, dunno about that scenario. The turnover ratio is so historically high in this industry it requires these companies to hire newbies to keep the freight rolling.
Putting these guys into an O/O position just to keep their costs down, isn't a perspective I personally envision.
That's just me though.

This suit was filed in Feb. 2011, so May was required to respond within 30 days. I wonder what they said.
I have heard that May has a policy of deducting money from the driver's paychecks for what they consider "excessive idling". Did not see that mentioned, and I would think it had more legs than the other complaints.

After reading the link,,,hmm seems a lil frivalous to me
$50 a day for students=$350.00 a week(standard industry rate) check any 5 training companies and that # stands out
If you choose to send your check to Comdata(i guess thats their only option?,hard to believe that in this day and age,but who knows unless you drive 4 them) and you withdraw your funds thru a ATM yes there is a fee,just like i have my check electronically sent to my bank and when I make a withdrawl, again a fee(hmmph the price you pay)
Also seems odd that this was filed back in Febuary and just coming to light on the web forums(but i guess if it dont involve you you wouldnt kno)
In the end i bet even if successful the avg Driver would see little if anything in a monetary sense,cause in most "Class-Action" cases its the lawyers that benefit the most,if it was as bad as they claim as in so many cases of Trucking firms caught with the "Hand in the Cookie Jar" the best solution is to fold( I.E. ARROW trucking)

Not taking sides here. Maximum on-duty time per HOS=14 hours. Max driving time since your last 10 hour break=11 hours. Any way you slice that one, it's less than $5/hour. Assuming you utilize more than 10 hours of your available time. 10 hours on-duty=$5/hour which IS less than minimum wage. That's just math. What the court gets to decide is if trucking companies are exempt from the minimum wage laws.

Somebody already sued Gordon Trucking in Washington state for this same thing and won the case.
The only result I'm aware of is that Gordon no longer hires student drivers from Washington state. They just stick to hiring from right to work states where the attitude toward workers is that they should just be happy they have a job and keep their mouths shut and their minds on the job. -
Not sure if they still do this, but JB Hunt used to issue a "Cash advance" on request. $50.00 limit, only one per week. And they charged drivers $10.00 to issue the advance. Of course, if you cashed it and had to pay over-the-counter fees to a truckstop you could lose three more dollars.
$50.00 advance. $47.00 to spend after cashing it. $60.00 deduction from your next check. -
This is not new, and has been posted when it happened IN THIS SITE
I remember the plaintiff's wife crying like a typical "I should not be held accountable for my own actions" citizen when this happened. 90% of what is in the suit is NOT news to a new hire...you know what you are getting into. The Comdata part is a joke..."What? I have a to pay to use an ATM?" SHOCKING!
Notice, the training pay lasted 2 months...sounds like a real genius trainee!But wait! IT MUST BE ALL MAY'S FAULT!! -

$350 a week sux, Although If you want in the industry this is the way it is period. Sounds like this person that filed the law suit was a greedy sob. I mean come on its not like he got his check for his first week of training and was surprised, the pay rate for training is clearly stated everywhere!
