They expect an appeal and I am sure it will come. I wonder what the other driver and his employer settled for, of the pickup truck.

by reading it, it’s his own fault.
“Street’s truck was driving on U.S. Highway 84 when a pickup truck heading the other way crossed the center line into Street’s lane. Street’s actions to avert a crash led to a rollover, and the force of the truck cab’s roof caving in led to neck injuries that left Street paralyzed.”

I’m not leaving my lane of travel.
so, guess he didn’t get a “failure to maintain control of your vehicle” ticket.

It’s s as bad deal, but by saying “the air ride seat didn’t lock and went upwards towards the roof as the roof was mashed down” all air ride seats will when weight comes off them, go up.
Just sit in one, then get up, it raises, (Ooh, Ahh) never seen that before.

I’d say his own actions, had something to do with this.
Next time, while riding with someone, he should say, don’t swerve and run off the road.

was taught, no matter what, never quit driving.
If you do, you’re gonna die.
Like some idiot jumping out of his runaway truck going down a mountain, usually gets ran over by his trailer,

Main thing if you were driving the right way to begin with, the truck wouldn’t be out of control.

Frivolous at best, worse for all of us, no matter who we are in this industry. It shows where the problems are with trucks, they can not be designed to have a safety cage to protect the occupants, trucking is a dangerous occupation and this proves it.

I Hope Damiler wins in appeal, as I have said many times, the real problems that this industry has are lawyers and these big payouts. Can't go after the actual cause of the accident so they go after anything that would make them their commission - 1/3rd.

We need tort reform, we need it where there is no choice that a judge can't allow these types of lawsuits and the lawyers who bring them need to lose their license to practice.

My Volvo drivers seat goes down when I get up. Guess this is done for this reason. It also adjusts as I go down the road over hills.

Well, I don't know if its in the article I posted, but I read that Daimler offers a "rollover seat" option that, when it detects a rollover, will pull the seat toward the floor and all the way back and lock the seatbelt, to try to minimize driver head trauma from the rollover. It's saying the seat didn't go down as it COULD have had that optional seat been installed.

    W923 Thanks this.

Ifvhed had that bent adjusted that bolts to the floor and adjusted to hold seat where it rides too.
Or if he’d drive the truck and not made a bad decision.
Or if he’d stopped and ate up the road, he wouldn’t have been there.

If a job is worth doing, it's worth doing right. Most schoolboys that didn't grow up in a corrupt environment learnt this in the 60's and 70's.

If safety is Job One or if it's Safety First, then walk your talk and pull out all the stops to make it safe for the little guy.
    No excuses either.
