The thing you have to remember in a lot of these cases are accidents are NOT assessed in the same way they are when it involves two four wheelers where one party gets to blame and that’s it. It’s black-and-white, 2+2 = 4. When a commercial vehicle is involved. They often are able to place a percentage of the blame on the commercial vehicle based on basically unlimited factors. (Lawyers get ahold of it) I knew a driver years ago who also was a trainer. He told me about an accident he was involved in during his second year of driving. He was passing through town and going through an intersection. His light was green. The cross intersection light was red. A woman on her cell phone who was pregnant ran the red light slammed into the side of his trailer , she survived the accident but she was eight months pregnant and her unborn child died. The lawyers got a hold of this case. You think it’s a no-brainer. She ran a red light was on her phone, her fault 100%? That’s not how it turned out. it got tied up in the courts for over three years. In the end, they determined that the truck driver had been going 4-6 mph Over the 45 mph speed limit several blocks back up the road. He was going the actual speed limit during the time of the accident. But prior to that he was going a little over. Through the investigation, they were able to determine that he would’ve caught at least one red light and would not therefore have been at the intersection where the accident took place had he not been speeding slightly. based on this, they put 12% of the accident blame on him And based on that 12% jury was able to award the woman $2.5 million for the loss of her unborn child. You can’t win if you get in an accident even if it’s 100% not your fault the lawyers are still gonna get a hold of it and make nonsense out of it.

I own a Corvair, it is a safe car, owned pintos, and never had one explode.
There is no safe car, except the one that you are not in or near.
Just an FYI,
I am betting that the local law firms here where they claim a billion dollars in lawsuits, are trying to figure out how to sue the trucking company or the state for the accident.wis bang, Deere hunter, W923 and 1 other person Thank this. -

Here’s another example where a truck driver/company would be sued to within an inch of their lives. But, in this case, probably nothing will come of it for the Subaru owner.
