    IDK, my attempts to get legal advice from OOIDA have been as frustrating as dealing with DOT. call, hold, call, hold, repeat. finally get someone, takes your number, someone will call. no one does, call back, hold, call, hold. take your number again, repeat.

    IMHO, scalehouses are on a very thin line of constitutionality to begin with. I think truckers are willing to play ball "for the greater good". I want them to get unsafe trucks and drivers off the road too. But if they keep up this horsepuckey behavior, I think they can expect a backlash. my luck has been worse than yours, it's about 1 in 2 for me. And friends who have had some sort of technicality lawyer-cop crap pulled on them is every week a good carrier I know gets hassled and mistreated over a total non safety issue.

    That is some bogus BS that I mentioned in a thread months ago and someone replied "if you run legal you have nothing to worry about". But these jack booted thugs so self important can issue a warning that screws up your safety scores. It is the most convoluted beauracratic bull #### ever conceived and should be scrapped as a broken system. But it won't be. Pisses me off how screwed up regulations are. Guys think you are guilty of something if you dodge the scales .... I dodge scales and route around them all the time to protect our safety rating from dick head cops on power trips. And my equipment, paperwork could pass any inspection, any time randomly, not done by some jerk off. But why take the chance? Who needs the hassle? I will be working during the blitz .... and I will be dodging every scale in my path because of BS like this.

    I had a similar thing happen at Clayton, NM. BOL had a different date on it. The gleefully giddy cop pointed it out as proud as a potty trainer with a little turd in the toilet. I said, "the BOL's wrong". He says, "Well you signed it, you should have checked more carefully". I said, yah but I signed the log book too. In court I pointed out that just because there is a descrepency does not mean the log book is wrong, it simply means one of the two is wrong.

    Did he ask you to sign the inspection form? I think at that point, I'm already out of service, I would decline to sign at that moment in good conscience just to see how far they are willing to escalate this thing. I can only imagine state troopers would be called in for backup. Just remain calm and explain you might still sign before going to jail, just want some more clarification, just keep stringing them along. Meanwhile hopefully someone sees just how truly chickenspit this inspection has gone and decided to dataq it on the spot out of the system.

    Been really lucky over the years getting inspected at scales and log book checks. Have to say every dirty inspection was absolutely deserved. I just figured out the game. If I did my 10 hour break and know I have to cross the scale in 15 minutes or an hour away, I do my 15 minute pretrip and lollygag along my way to make my arrival time at the scale look legit, heck I might even give them 10 to 15 extra minutes because I know I can make that time up later-- even when I was on electric logs.

    Not sure but sounds like you put a lot of details in the 'comments' section of your logs? Like City, State then activity like unloading at customer or something? Not me, just City State pretrip or fuel as the activity never 'drop' or live (un)load scale load or whatever.

    Funny note, the last log book check I had, they were so hyper focused on the 30 minute break, I could have logged 7 days of drive time with the proper 30 minute breaks and would have passed. They kept saying how honest I was over and over lol if they only knew.

    Signing an inspection form or citation is just acknowledging receipt. There is no implied agreement with respect to the contents of the report. Nothing worth getting all Perry Mason over with Officer Friendly.

    I see no problem with it. If the cops wanna get all legal technicalities with it, why cooperate ? Does it benefit me to sign it ? Once a cop has made it clear he has no interest in safety, only hassling law abiding citizens, I see no reason to cooperate in the least. refuse to sign, refuse to answer questions. only provide ID and demand a lawyer.

    DY,you never stood a chance with this cop after he saw you had all your ducks in a row,there was no way you were leaving without a ticket for something. Hate that it happened to you.
