Did you get your answer back from the DOT yet? I see by your foul posts you are fishing for a thread lockdown to save you lol

I would qualify that as illegal. Just because the regs indicate the time shall be documented on the log between the appropriate time markers for the activity-- if out of the sleeper log Off Duty, if in the sleeper, log Sleeper. The DOT officer was correct, you were logging falsely but sounds like he did you a solid by letting you go since it is admittedly a chickenspit violation. I would not be surprised if they make no such exceptions in the upcoming 2018 Safety Blitz which is focusing on Hours of Service in June.

Did the OP get the simple explanation of 10 hour sleeper rule. Ha ha
Just log it as you do it and do it legal. I think some of the old stuff of logging 10 hours in sleeper or Off Duty for 10 is just old school. I was trained to always go into sleeper berth when possible. They said it was because they wanted their drivers to always be rested and ready to drive. I think they had another idea. That stuff doesn't go in today's trucking.
So any combination of sleeper berth and off duty time will work for your 10 hours off -
I had the following conversation with an agent of the FMCSA this morning. They are obfuscating this question. I will not take any further action. There are links that anybody that wants to may follow and see how far you get. I am out of this as of now! Hopefully an admin will also lock this thread too.

Perhaps whoever came up with the rule and regulation about the 10 hour break was a team driver we're there almost always having there 10 hour break in the cab of a truck, however the rest of us solo drivers don't have that to worry about and how you take you 10 is up to you some drivers are good with 5 hours sleep, and spending the other 5 lounging around the Flying J lounge room watching the 200th episode of Law & Order. While others need more rest between 7 -8 hours which barley gives enough time to shower eat and relax.truckdriver31 Thanks this.

Maybe it would be better if line for "sleeper berth" was called "sleeping" instead.
