FMCSA HOS Guidance change!

    You think ? I might prefer the chaos to the uncertainty and guessing games we play in regards to some of this crap that is not possible to make sense of because it was birthed from nonsense

    Ive already been, and will continue to use yard move for anything on Private Property. Makes it really simple... Private property = Yard move... Public roadway = Drive

    Except the law isn't on your side.
    Sure, it's what FMCSA wanted I guess by adding yard move, but the definition of Driving is "All time at the controls of a CMV." Heck, there is even guidance stating using a PTO that has the controls in the cab is drive time.....

    Now will you ever get a ticket? No. Will you get sued and loose a 20 million dollar lawsuit if you get in a wreck? You betcha. After all your are such a danger for flaunting the law and driving in reckless fashion or some other b.s line the lawyers will come up with.

    Instead of FMCSA fixing the regs, they are weaseling out of their responsibility and pushing the liability and on the driver and company by this guidance.

    P.S. I'm not disagreeing with you on how you should use it, just letting you know FMCSA isn't making this guidance for the drivers.

    I think if truckers made the rules, there would be very few rules.
    And the rules that were made would make sure that truckers could do anything they please, any time they please.

    That is, of course, only my opinion.
    It is formed by how I see so many truckers drive out here.


    Truckers should have some say and influence, but they should never be the ones making the laws.

    Oh I know... I HATE guidance... I want regulations with the binding power of law when it comes to anything HOS. But it is what it is... Besides the regs directly contradict themselves in more than a couple places.

    That is likely to happen when they add ever more regs without going back and rewording the previous ones.
    I guess that would simply be too tedious.

    Just another useless micro managing Regulation, or change of guidance. So in other wards it’s now OK to do what everyone’s been doing forever. Noted.

    I'm going to tag @brian991219 on this reply. To better understand why the FMCSA and for that matter, the whole of the USDOT have contradictory rules is because the FMCSA/DOT is the typical bureaucracy with MANY little "kingdoms" inside it. One office inside the FMCSA can make a rule that affects something another office handles and if these rules are not reconciled, confusion can result! I have once seen a top 25 MEGA safety director throw a book across the room in frustration at how contradictory the FMCSA rules can be. This crap is one reason the US Congress slapped the FMCSA good several years ago about their OSA rules then in place.

    I am separating the DOT from the FMCSA in my reply because it's important to remember the rules in title 49CFR is for more than just the FMCSA. I know several people that work for Norfolk Southern and CSX railroads. The 200 series rules are just as confusing and contradictory as the 300 series are.

    We need a revolution. Not holding my breath tho. Too many selfish people, too many afraid to stand up for themselves, too many sheep unwilling to think for themselves. Itll never happen
