Force to move truck during 10 hour break because of emergency

    A lot of companies don’t have that option on the logs. I never did when I was OTR. Now, I’m a Mon - Fri, home by 5:00 driver and I have the option and don’t need it. Lol

    On a side note, one of our drivers is so obsessed with his clock, he switches to PC as soon as he leaves a main road. Side street? PC. Drive way? PC. I’ve tried to tell him a couple of times, but...

    Just taking an overview of this thread and the replies I think some folks are taking this much too seriously. Several months ago I was talking to a safety guy about an FMCSA safety audit they had back in 2017. One of the ladies looking at their HOS records took note of some clock busts. She then looked to see how the carrier addressed them. She was satisfied and moved on. Later she told this same person they expect to see some clock busts because it is the nature of the business. In fact, a carrier without a few clock busts sets off a red flag about false log records. This is why it is important to remember the FMCSA during an audit looks for what's there and what's NOT there.

    I will go out on a limb and say it is virtually impossible to have been an OTR driver for more than a year and not have a bust. It is a chronic problem with reefers. I am not saying the FMCSA overlooks these busts. I'm saying they expect them.

    The last thing you want to do as a driver is to use part 395 as a club or some form of a trump card to trump a cop and/or customer orders to vacate a property. Refuse to leave and most cops will order up a "hook" to move you.

    If you can set PC do it and move. If you can't move anyway and notate it. Let the carrier know what happened as well. Just keep it on the CQ. Speaking of the QC this guy I spoke to told me several times after a driver busted a clock they had a QC record to show the auditor.

    People really need to stop thinking there are DOT cops hiding behind trees with binoculars with some form of ESP that tells them you have a HOS violation. It simply doesn't work that way. I would be interested in what @brian991219 has to say on this?

    I would have used PC for that, or if I was around 2-3 or 7-8 hours into my 10 I’d just do a split sleeper.

    Hank is way too by the book for that. PC just because it's a side street? Bwaaaaa!!! That's fraud, Bobby! Maybe you can use yard move on a driveway, but that's what we call a gray area.

    The italics is meant to convey how he almost whispers when he's disgusted by something, or if it's something that excites him due to his love of technicalities and rules and maintenance, when he gets to use a terminology. Y'all know what I'm talking about.

    I dunno driver, then you're only going to have 13:57:00 left on your 14 after you finish the second half of the break. Sounds like you're cheating the company out of 3 minutes of work time.

    I can't believe the logs/safety "critters" have not called him out on that. If that pops up on a random audit, (it certainly won't be hard to spot), the company will have some "splainin'" to do. Not to mention log falsification on the driver's part. He was probably asleep during that part of Truck Driving School.

    I don't know, I just meant he's unrelenting, and it's more work than is needed. He's the only one doing it, no one else even cares, but he still refuses to budge despite people telling him to stop. That's Hank Hill 101.

    Yeah, I didn’t realize some companies didn’t give that option. The two I’ve worked allowed it as long as we follow DOT usage rules.

    As usual M you are spot on. During audits I expect to find violations. That said, short period to move the truck as in the OP's situation can easily be explained in remarks/notations and I don't know a single motor carrier officer that will cite that.
