So my ex boss small 6 truck owner is telling companies I've applied for that I didn't report an accident. I've never had one, I left because I wasn't being paid on time. Currently trying to get on with Ozark and that's the only hold up. 8 years experience with only a warning for speeding in 2023. Should I take legal action because a few have turn me down because of what he said.

First, are you 100% sure these prospective employers are telling you the truth?

nope you can’t on your own but there are a couple lawyers who are in the business of acting like an employer and recording the conversation to catch them in the act then suing them on your behalf.TripleSix, Speedy356, FullMetalJacket and 2 others Thank this. -

Tell the employers that have turned you down for what your former employer is claiming to send you a copy of the Employment Verification Form. Verbal over the phone sounds like BS to me. Nobody calls anymore. Too much litigation potential without a paper trail to verify your background check in case of an FMCSA audit.
It's pretty much SOP to email, fax or mail a generic form to the previous employer and have them fill it out. It asks basic questions and doesn't leave much room for the PE to make claims about your performance. It's basically just there to check the important things like equipment experience, working environment, accidents and employment dates.
If your PE filled out that standard form with erroneous or slandering information then you can start calling lawyers. Without it in writing you don't have much ammo for a suit. Plus, as mentioned above the recruiter could simply be lying to you. They're known for being BSers.wis bang Thanks this. -
First secretary tapping phone calls in some states is illegal and a defamation lawsuit is very expensive so you better win or you could be out of in the neighborhood of $10,000.Second there has to be a paper trail of what the former boss is saying I would find it very unlikely that they are having a phone conversation on Ozarks side.they are much to large of company not to have it in writing Honestly the whole thing sounds real fishy that a former boss would send out a reference on paper that wasn’t fact
