Which as always shocked me when this comes up. In the sleeper = sleeper, out of the sleeper = off duty. I can't see how people make this so hard.
Of course I'd be just as happy if FMCSA got rid of sleeper, and made a single duty status of Off Duty.

I would like to see only 2 lines. Off duty for anything off duty. and On duty for driving, fueling and the rest
of it. No need to have on duty driving and not driving separate. -
That's how it is effectively in Canada, they trust a grown ### adult truck driver to get their proper rest without regulating where the rest will take place.ZVar Thanks this.

I heard that they won't give you a hard time if you're only peeing while in sleeper berth status after 10 hours. However, if you're pooping too, they get really anal about it, be careful.

Not quite sure what you mean, but the log statuses in Canada are not too much different than those in the U.S. The definition of each is pretty much the same. Where we differ significantly, aside from drive time, is the flexibility of both the 10 hours daily required rest and split-sleeper.
For the daily 10 hours rest, only 8 of the 10 must be continuous. The remaining time can be in one period or more than one so long as the least of which are at least 30 minutes. Any of the periods can be off-duty or sleeper berth or any combination thereof. Also, up to 2 hours can be deferred to the following day so you only have to have 8 hours on Day 1, but 12 hours on Day 2 (10 continuous and 2 non-consecutive).
Split-sleeper is very flexible. For single drivers any two periods adding up to 10 hours so long as the least of which is 2 hours and both are in the sleeper. Teams only have to do 8 hours total, the least of which is 4 hours.Last edited: Sep 23, 2017

Just log off duty... Simple as that. Nothing in the law that says you can't sit or sleep in that parked truck in your off time.. I rarely log sleeper berth anyway. Seems like a trick bag to me. So our safety guy says just throw one in every now and then but legally off duty works as good as sleeper berth..better, you can get out of the truck!

This is exactly what I was told,. Example, I just finished my drive shift. I parked the truck went off duty and ran into the truck stop. Came back out to the truck, logged into the sleeper and now Im in the sleeper. Im browsing the net for 30 mins or so but Im still in tge sleeper, so Im logged in the sleeper.scottied67 Thanks this. -
This is what I'm trying to say may not be true WITH SOME CMV cops lately. Apparently some are getting real ticky tacky about status used, and sitting in the seat and not logging Driving has also gotten some cited.BB203 Thanks this.

I'm old school and it's always been "no distinguishment between off duty and/or sleeper birth"
I think where the confusion comes in where you are using a split sleeper birth and the new rules say 8 hrs minimum sleeper birth.
So if you take 10 hrs off it doesn't matter.
