The regs were changed back in 2012 to allow logging Off Duty while sitting in the driver seat. The qualifying criteria was that the commercial vehicle must be Parked.

There has always been a requirement to log "true, correct and current" with regard to whether the driver was in the Sleeper or out of the Sleeper for their off duty time. Where the true confusion comes in is the truck stop lunch counter big mouth truckers who talk with great authority about every subject but in reality are clueless about most subjects regarding trucking regulations.tscottme Thanks this. -

If you claim sleeper for 34 hours you volunteer for an easy ticket. If you claim in the sleeper for 34 with brief off-duty periods you won't get to feel like "Norma Rae" while telling people about your 1-man Crusade to overthrow the FMCSA with storytelling.scottied67 Thanks this. -

you said sleeper birth is off duty. So book it as off duty. Still true and correct . -

I am not stating any laws and am not going to argue them.
I have logged all but about one year since 1974, always park for the day and log off duty, the last 25 years with a large carrier with a tough log department, if I am doing it wrong I would have gotten letters.
The sleeper line on logs was created for running team. I parked Saturday at 5pm and will log off duty till I leave to load Monday.
That said I have never had a ELD and have been given the ok to stay on paper from our log dept.

There's no denying that Sleeper is an Off Duty status. The crux is that it is a specific place in this Universe where the driver is off duty.
Let's do a scenario--
Driver logs Off Duty for a whole week and produces say 3000 miles. This driver uses an over the road sleeper equipped tractor. Next week through no fault at all to the driver, a car wrecks with this truck and the car driver dies. In court the driver is called to testify under penalty of perjury, to tell the truth the whole truth and nothing but the truth in regard to where they took their rest the previous week. As soon as the driver says they slept in the Sleeper portion of the truck while logging Off Duty all week, boom now the driver is going to share in the financial penalty compensating the victim's family because that is Log Falsification which falls under the Fatigued Basic under CSA. As you know, Fatigued ranks right up there with Drunk Driving.Last edited: Sep 25, 2017
