I thought the ticket was 3 grand for using your
Cell phone in a commercial vehicle.

What is the statute section, subsection, etc., that you were charged under. Refer to my previous post; eg., 346.89(4)(b)2a

OK so this violation will carry CSA points for sure and affect your PSP for sure. This will make it exceedingly difficult to get another driving job if they fire you. I would prepare for a $2750 fine from this violation as well, let us know whether you get slapped with that too.

I know in California for example, no screen aside from a GPS screen is allowed to be visible by the driver while driving. Maybe Wisconsin is similar in that regard. I see truck stops sell those cell phone mounts all day long and it gives drivers a false confident impression that it must be legal to mount the phone within view while driving, but remember, truck stops also sell illegal radar detectors too.

That is the one with $183 dollar fine attached? You might be able to fight it or reduce it as others have said but when this violation is listed on the Driver/Vehicle Examination Report, the DataQ goes right back to the same officer who wrote the violation, so chances are very slim the officer will agree with the DataQ process and remove the violation off the driver or equipment.

I mean the best case scenario would be to have him agree that you did not violate fed rules by touching the phone one time one button, but did violate local laws by having the phone within view then therefore he would drop the federal violation and keep the local violation.

Im confused. Why would I pay $2750 if the ticket is only $183?

Is that the price you have to pay if you fight it and lose?

Did the trooper see you use the phone and then did a level 3 or was it regular dot stop

The $2750 is the set federal fine for using an electronic communication device while driving.

The $183 fine sounds to me a local ordinance set fine amount for that particular jurisdiction.

I am very curious to know if you do not have to pay this $2750 fine though, keep us posted as you go through this.

Is the $2750 set in stone? Had a friend get a ticket for talking on the phone without using a bluetooth. He got popped by a state trooper and cited but I remember him telling me it was like $1200 or $1300, but I never actually saw the citation. The $183 definitely sounds like it was not federal. Ive heard the federal has a min and max fine though. But im honestly clueless on it.
