    Any one that wants and requires you to run illegal you want to get away from anyways, good riddens to them now move on to a real driving job.

    Talked to 2 other drivers I know that were both let go today as well as 3 who still work there (for now) Seems they let 20-30 out of 150 drivers go today. One of the drivers that's still there said they lost 2 dedicated routes at the end of April and another said when they came in tonight, all the heavy haul trucks and equipment were gone from the yard.

    Defamation is a tort, not a crime. Falsehoods are usually not illegal. Exception are lying to a cop or lying under oath, etc. They can be the basis for a tort (i.e. a civil suit), but not if the liar indicates that they are just expressing an opinion.

    When I left Swift I applied for and got a copy of the DriverFacts report they had published about me (Swift wasn't using DAC at that time). The report had my employment dates, my eligibility of rehire, a list of my drug tests with results, and a crash history indicating dates, preventable/non-preventable, and DOT reportable yes/no. So yes, there are other things your employer may report besides just hire dates.

    Guys there is the laws and then there are court cases that are decided.

    A former employer can answer questions about work performance but most of the idiots who answer the phone seem to not get what they can't say.

    What can't be said is anything false. Work performance is also ok but most of what is said is off limits because of the lack of standards used to judge someone.

    If there is an ongoing dispute of something in the employees records it is off limits.

    Now you all can say I'm wrong but I have actually sued a couple of former employers for false information. I learned through that what I can and can't say, the judge was clear in each case what has been decided in the past. On top of that there are investigation firms - lawyers - who will act like potential employers to catch the former employers and sue them for false statements.

    Out of curiosity, how did the court(s) determine damages in these cases? Or were you just asking for injunctions?

    Got an email this morning from the VP of operations clarifying that I was "laid off subject to recall" because I emailed HR on Friday and requested a written explanation of why I was let go. The brief explanation was that a downturn in business required a "streamlining" of operations and discontinuing of the heavy haul division. Have to see where it goes from there.

    If flipping burgers paid better I'd look into it. The money I make is better than most where I live.
