Yeah NYS dot can be nazis sometime, they will look for anything to write u up so some bureaucrat kind say look at all these violations are boys are finding and protecting the public from these outlaw thugs driving death machines on our highways. I got wrote up for a broken triangle good thing they caught that I might of killed someone

Don't the state DOT's maintain the rest areas? Wouldn't that give them jurisdiction to use them as a means to enforce the FMCSR's?

The state does maintain the rest areas ,but they are just that "Rest Areas" ,they should not be in there in the middle of the night "doing sneak attacks " on sleeping drivers and taking up spaces needed by drivers looking to park and take there 10 hour break in the middle of the night. There is enough fixed scale houses they can keep open 24 hours a day if they want ,and set up inspection areas in rest areas in the day time if they want . The middle of the night surprise inspections in rest areas are " Gungo ,over top tactics" by clowns looking to write tickets to generate revenue and rack up overtime . It's not about safety.
Not too many industries have to deal with this non sense with out probable cause of something specific going on in that area or time of night which is illegal or dangerous. I used to own restaurants and had to deal with health inspectors and fire inspectors. They always came in during normal business hours , never barging in at 2am for
a random "gotcha " inspection . New York DOT has been ramping up this middle of the night inspections in rest areas over the last year ,and its highly coincidental with the hiring of 160 more DOT cops with the federal money gave to them by the federal government to implement the ELD mandate. I'm sure those Federal funds have been burned through,now they have to find additional ways to pay for these newly hired clowns .

I can't help to view those DOT cops as real cops wannabes, real career losers just like the traffic court judges - underachievers. I may not be right, I am sure I am not and I do realize there must be DOT enforcement but for the life of me I can't help the feeling of disdain towards them.TheLoadOut and singlescrewshaker Thank this.

I used to get Caught in these Traps" in West Virginia",Draggin my Arse"...Way Too Tired to Drive..and I Knew It.Coast into the Rest Area.Oh,Geez Theres Hillbilly Dot Welcome Wagon here! WTF!! Yes,if they Failed to "Shake Me Down ( While I was still Moving). Im taking my 10 off.I Cant paticipate in an "On Duty Inspection" im in Sleeper Berth.JMO

It had to. Now when on ELOGS, I often avoid rest areas for the very reason of them (DOT) resetting my sleeper time, forcing me to stay there for 8 more hours after the official inspection. I would not possibly imagine a good reason for a random inspection in the middle of a night while the truck is parked and the driver does not appear as a shady character.
Sympathizing or even justifying such actions, I suspect to be a result of some
