HOS question

    I'm sure this has been answered a hundred times but I couldn't find anything on it. If you run out of hours at a shipper, and they wont allow you to stay there, and there's no where to park in the next 10 or more miles. What do you do?

    That's legal? Would you off duty drive it?

    You can't drive legal off duty unless you are loaded and not dispatched.

    If you have an empty trailer you can use personal conveyence off duty. . Some carriers say no but FMCSA says unladen and an empty trailer is unladen .
    Loaded log on duty . A log violation is a less serious offense than log falsification

    So there is no legal way around it when you are under dispatch/loaded then?

    flag it than note safe haven shipper or reciever would not allow parking. the land owner can file charges if you refuse to leave after you have been notified that includes signs posted. it5s a lose lose for the elog.....

    If you stay, you risk trespassing charges.

    If you leave, you are operating while out of hours. Pretty well hosed anything you do.

    That happened to me once, I refused to leave. Only needed about an hour and a half more to complete the split sleeper. They kept banging on my door, I told them to call the cops if they were serious otherwise leave me alone. A few minutes later 3 police cruisers showed up. I got out with the little green book in front of my chest trying to explain to them that the Department of Transportation forbids me to operate the truck when I am out of legal hours. They twisted their heads like a dog does when it hears a funny noise. Finally we agreed they would escort me across the street to the Dollar Store parking lot.

    I asked my Safety guy about it, his response was that responsible professional drivers know how to trip plan and not accept mousetrap loads like that. Fine. I turn down all mousetrap loads now and the planners hate me.

    Actually it is simple open your fuse box pull the 2 inline fuses, take out your paper logbook, make a notation that your elog system went down. Take said fuses go to your battery box hook a piece of wire to one side of the fuse, and touch the other on the opposite battery terminal. Then replace them into the inline fuse holders. Run on paper logs till you get back to the terminal.
