The OP here is spitting in the wind.
He was operating and using a hand held phone. Whether texting or whatever.
You did it, learn from it.
You have NO LEGAL RECOURSE.

The difference is the display is mounted up on the dash, where it can be seen and you can hit a button to view a message at any time. Only you can't go down the road typing on it if the keyboard lock is enabled. -
It doesn't matter if you were typing a message or not... If the cops catch you driving a truck with the cell phone IN YOUR HAND at all, YOU are getting nailed. Period. And tell be truthful, with the idiots I see out here texting or hacking into a hand held phone, weaving in & out of a lane, it wouldn't break my heart if the penalty is higher. In addition, any company worth it's salt would have a no tolerance policy towards this like mine does. Why? It's an 11000$ fine to any company that allows drivers to use a hand held phone while driving. Any YOU got caught red handed with that phone in your hand. That cop isn't going to care if you were typing of listening to the radio through that phone, there are signs announcing its illegal for a driver to use a hand held phone. Good luck with trying to fight that violation. If somehow you get another driving job, maybe you will think twice about grabbing a hold of that phone while driving in the future. In my state (NY), it's loss of license after 3 texting violations, and if you get in a fatal wreck while holding that phone, the 2750$ fine will be nothing compared to a stiff jail sentence, or your carcass going home in a coffin after the scrape you of the road. Get it?

He admits to touching it and changing the channel. It is a violation to even hold one. -
It is a violation to even be *reaching* for a cell phone while operating the commercial vehicle.
slowpoke89 Thanks this. -
DataQ to start with.... You get a chance to talk to her supervisor is what usually happens.... If he won't remove it... Inquire how you can get it removed thru the court system...You will want to check your drivers report at the DMV in a few weeks.. Not sure how long they take to hit your record.... Might want to get to crankin out the apps n get hired before it hits your record... Prove to someone your a worthy driver... N deal with the ramifications after the fact
