I got backed into at the truck stop - is it my fault?

    Insurance companies always assign fault to both parties. Sometimes it is like 100% one party, 0% the other party.

    In this case, you were 18 inches violating the parking space belonging to the driver, so I assign 18% fault to

    I won't comment on the OP, but I disagree with people who flatly say that because a driver hits someone who is parked, that it's his fault.

    I've seen some HORRIBLY parked trucks at truck stops. The later in the evening, the worse it gets. I've had trucks park and block me in, I've had trucks park where ingress and egress out of the parking lot from some or all of the parking spots became almost impossible.

    If I hit you in a parking lot the first thing I'll do is check to see if you're parked in a legit spot. If not, I've got a camera in the truck and you'll do battle with our insurance company. You can't just park ANYWHERE you want.

    Hint: If you don't have paint lines on BOTH sides of your truck when you are parked, or a paint line and a curb, you are not in a legit spot.

    The problem with saying it isn't your fault if not in painted lines is you have the option to not move till the object in your way is moved. If you can't see you are about to hit something at parking lot speed you were not paying attention.


    I am not defending the people who do the make a spot parking. It sucks but doesn't mean I go around draggin my trailer across them either.



    I have had countless dry vans and reefers intrude into the spot I have selected before. I get it they have lots of overhang. I have never hit one though cause even if it's the pope waiting I get my ### out and look

    Do yourslf a flavor invest in a good dash cam. Next time it maybe the front of your truck that gets back into!!
