Is it legal to carry a bottle of alcohol on the truck in a toolbox?

    i am not going to #### on a guy for having a beer in his off time. but there is alot of sorry losers out here in the truckstops every night that will definately call it in to your company if they see you enjoying a beer in your off time and possibly even the cops.. its best to just leave it at the house or the hotel room..is it legal.. no but neither is driving 1 mph over the speed limit... its your choice at the end of the day.

    Most will agree, it's a silly question. I know weed here is allowed in a car if it's locked in the trunk. Pretty amazing the level of denial here, however, thinking booze is okay anywhere in a truck. If it's in the toolbox, it's in the cab., and the "empties" are at MM 166, 182, and so on. I mean, it's not like it's hard to find.
    Quite possibly the winner for the post of the year,,,

    Specifically the regulation is Federal Register :: Request Access

    This is the important part. Note, it says possesses. It doesn't give a location of where in the truck. Putting a 12 pack in the trailer is still illegal, unless it's what is being shipped.
    (a) No driver shall—
    (3) Be on duty or operate a commercial motor vehicle while the driver possesses wine of not less than one-half of one per centum of alcohol by volume, beer as defined in 26 U.S.C. 5052(a), of the Internal Revenue Code of 1954, or distilled spirits as defined in section 5002(a)(8), of such Code. However, this does not apply to possession of wine, beer, or distilled spirits which are:
    (i) Manifested and transported as part of a shipment; or
    (ii) Possessed or used by bus passengers.​

    Hell i own my own truck and even I dont carry booze in it. Just not worth the risk. Me personally i only drink when im going to have 72+ hours at home and can take 24 hours off work after drinking. Cdl is worth more then a single beer.

    And frankly all the cop needs to do to ruin your life is find an empty of the same brand along the side of the road or in the truckstop...and your then screwed.

    There was a recent post from a driver who got caught with a case of beer in his toolbox.. Last I read he was still looking for another job.

    I would link the thread but I’m feeling a bit lazy at the moment..
