In January 2018 it is legal to run paper logs if your ELD is broke down. But you have 8 days to get the ELD fixed. It will be a major violation to log the 9th day on paper logs.

I never knew that. If I did I'd just leave the thing in the office I guess.

Idk it doesn't matter I'm back on 100% paper now at my current job.

If you find yourself in a situation where you violate your HOS, it likely won't affect you that much. If you can go 8 days without being inspected, and your company can go 6 months without being audited, then you have little to worry about. If you make it a habit, then the likelihood that it will affect you increases.

The key is to avoid putting yourself in those situations.

The key is to properly note in the remarks the reasons why and don't do it more then a few times a year. The FMCSA recognizes that (things) happen and will let a lot go provided it don't happen a lot. They might also want to know what corrective actions have been took to fix the problem. Too many drivers have this mentality that once you bust a clock rule the roads close and cops start coming out of the woods. NOTHING could be further from the truth. Moral of the story? Make notations who, what when and where and most importantly WHY!

I had a situation at our warehouse last week. We loaded a flatbed truck out in the parking lot. The driver informed me that by the time he got the load secured and tarped, he would be out of hours. I told him he was welcome to stay but he would be locked in the gate until 7:00 the next morning. He threw a fit about that but I told him with all the stuff we had in the lot that has "walked away" in the past, there was no way I'd leave the gate open until morning. He ended up pulling out about an hr after we normally close the gate, I just went back there later and shut the gate.

I once spent the night inside a locked gate. Had the best night possible. Quiet all around me and I got a pizza delivery company to come. I also had full use of the canteen and restroom. It is not a death sentence.
